RESOLUTION NO. 125 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING A VARIANCE FOR A CARPORT OF THREE AUTO SPACES WITH SUBSTANDARD WIDTH (EDWARD ARTMAN, V-6-67) WHEREAS, in the matter of variance application No. V-6-67, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by Edward Artman, llll~ Seal Way, Seal Beach, California. 2. Subject property is described as Lot 14, Block E, Tract No. 1009. Street address is 1109 Seal Way. 3. Subject request is for variance to allow construction of a three space carport with provision for construction of a second story apartment above. Total width of carport to be twenty-four feet. Preliminary plan indicates an exterior stairway to the upper deck (or future apartment) located in the required three foot side yard on westerly side. WHEREAS, the Planning Commission findings are as follows: 1. One written communication has been received from Mrs. Margery C. Murray, l017~ Seal Way, indicating her approval of this request. 2. The existing two car garage located on subject property is substandard in length and width and is in very poor condition. Removing it and building the proposed new facility will significantly up-grade the property. Similar up-grading should be encouraged for the many similar situations along Seal Way. 3. Two apartment units exist on the site. To construct a third unit (which is legally allowable per density requirements) a ,three stall carport or garage is required. The required size of stalls is nine feet wide by twenty feet long. Required side yards are three feet. Width of this lot is thirty feet (as are many others in this area). To construct a three unit carport, it is necessary that a variance for width of stall be granted. This is'found to be reasonable and proper if the upper deck is supported by columns, with no side walls and no interior partitions to interfer with opening of doors of parked cars, etc. 4. The outside stairway located in the required side yard is not allowable. Any stairway must be located within the carport. To allow for the space for such an interior stairway, the carport deck (or future upper story apartment) may project to a line seven feet from the existinR alley line (as shown on the preliminary plan). The ground floor level shall be kept completely clear except for the main support columns. flOt! .Ju:d ~ . . . It . .- "" Resolution No. 125 - 2 s. To provide maximum turning radius into these substandard width carport stalls the supporting columns shall be located the maximum distance possible from the alley line based upon acceptable structural design for the cantilevered upper story. 6. Seal Way Alley, to the rear of the subject location is fifteen feet wide. It is the only vehicular access for all lots on Seal Way (which front on the beach). To adequately serve the traffic generated by this area (particularly as density is increased by apartment additions such as the one here proposed) a twenty-five foot wide travel way and public utility area should be developed. The additional width required should be obtained equally from land located on each side of the alley. Therefore, as a condition of this variance (which allows additional development) a five foot wide easement for public alley and public utility purposes should be dedicated to the City of Seal Beach across the rear of subject lot adjacent to the existing alley line. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-6-67 subject to the conditions and requirement~ stated in the findings above. This variance shall not become effective until the five foot wide strip, mentioned in finding No. 5 above, has been granted to the City of Seal Beach and has been recorded. ADOPTED AND APPROVED this I hereby certify that the foregoing resolution was duly adopted at a regular meeting of the Planning Commission of the City of Seal Beach which was held on Wednesday, May 17, 1967, and carried by the following vote: AYES: NOES: ABSENT: Commissioners: CODlllissioners: Commissioners: Crowley, Jones, Lanning, Boeger None None 1109 ~ 'ttb.u
