RESOLUTION NO. 130 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING A VARIANCE TO PERMIT ENCROACHMENT INTO SIDEYARD SETBACK AT 1712 HARBOR WAY (JOHN B. HAMILTON, V-9-67) WHEREAS, in the matter of Variance Application No. V-9-67, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by John B. Hamilton and Betty A. Hamilton, 1712 Harbor Way, Seal Beach. 2. Subject property is described as all of Lot 288 except the westerly six feet plus the easterly six feet of Lot 289, Tract 2590. 3. Subject request is for a variance to permit an encroachment into the sideyard setback of one corner of an expanded garage. WHEREAS, the Planning Commission findings are as follows: 1. This property is wedge shaped and existing dwelling is situated so that the house is not parallel to the lot lines. 2. The extension of the garage to permit a second story addition will encroach a maximum of one foot into the sideyard setback or a total of 2~ square feet. The balance of the sideyard will be five foot or more. 3. Design of the addition precludes encroachment into the privacy of neighbors and would not be detrimental to the appearance of the neighborhood. 4. Ralph Oakley, 1708 Harbor Way, made an oral protest that the close proximity of the buildings could create a fire hazard. No other protests,. written or oral were received. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-9-67 as presented.
