133
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING A VARIANCE TO
PERMIT A BLOCK WALL FENCE SIX FEET IN HEIGHT
ALONG THE SIDE PROPERTY LINE OF A CORNER LOT
AT 141 COLLEGE PARK DRIVE (JEAN TRAVAINE,
V-11-67)
WHEREAS, in the matter of Variance Application No. V-11-67, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case was initiated by Jean Travaine, 141 College Park Drive, Seal Beach.
Legal description of property is Lot 176, Tract 5847.
2. Subject request is for a Variance to allow construction of a six foot high
block wall along the side property line of subject property adjacent to the
sidewalk of Stanford Lane. This wall to extend to the front line of the
house.
WHEREAS, the Planning Commission findings are as follows:
1. No oral or written protests were received.
2. By Resolution No. 70 the Planning Commission has interpreted provisions of
the zoning ordinance to indicate that wall construction in locations as
requested is not generally allowable under the code.
3. Prior to this interpretation of the Code by the Planning Commission, the
majority of similar cases of corner lots in the College Park West area had
been already constructed with such sideyard walls adjacent to the sidewalk.
However, a number of these walls were built with a corner cut-off adjacent
to the next interior lot to protect the interior lot owner.
4. The opposite corner property on Stanford Lane presently has a similar wall with
a corner cut-off at the interior lot line.
5. The neighbor on the interior lot adjoining subject property, Mr. Earl
Christensen, spoke to the Commission and did not oppose this Variance request.
He did request that a corner cut-off be established at his property.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance No. V-11-67 subject to the condition that a
corner cut-off be established at the rear corner adjacent to the next interior
lot on Stanford Lane and that this corner cut-off be similar in size to the cut-
off directly across the street on Stanford Lane.
