A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING A VARIANCE FOR A
CARPORT OF THREE AUTO SPACES WITH SUBSTANDARD
WIDTH AT 1013 - 1013A SEAL WAY (FRANK R. AND
DOROTHY L. OSBORNE, V-12-67)
WHEREAS, in the matter of Variance Application No. V-12-67, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case was initiated by Frank R. and Dorothy L. Osborne, 903 Presidio,
San Clemente, California.
2. Subject property is described as Lot 12, Block D, Tract 1009. Street address
is-1013 - 1013A Seal Way, Seal Beach.
3. Subject request is for a variance to allow construction of a three space
carport with provisions for construction of a second story apartment above.
Total width of carport to be twenty-four feet.
WHEREAS, the Planning Commission findings are as follows:
1. No written or oral protests are received.

2. A similar variance has been previously granted by Resolution NO. 125 at
1111 Seal Way.
3. Removing the existing substandard two car garage will significantly upgrade
this property. Similar upgrading should be encouraged with the many similar
situations along Seal Way.
4. Two apartment units exist on the site. To construct a third unit (which is
legally allowable per density requirements) a three stall carport or garage
is required. The required size of stalls is nine feet wide by twenty feet
long. Required side yards are three feet. Width of this lot is thirty feet
(as are many others in this area). To construct a three unit carport, it is
necessary that a variance for width of stall be granted. This is found to be
reasonable and proper if the upper deck is supported by columns, with no
side walls and no interior partitions to interfer with opening of doors of
parked cars, etc.
5. An existing stairway on an adjacent lot is connected to the top deck of the
existing garage on subject lot by a wooden landing. This landing is not
allowable for connection to future construction and therefore should be
disconnected when the new carport is constructed. No stairways to the second
story allowable in the side yard setback. Such stairways must be designed
and constructed within the allowable structure lines.

6. The ground floor level carport shall be kept completely clear except for the
main support columns. No sidewalls or entry walls or doors shall be allowed.
To provide maximum turning radius into these substandard width carport stalls"
the supporting columns shall be located the maximum distance possible from the
alley line based upon acceptable structural design for cantilevered upper ,

7. Seal Way Alley, to the rear of the subject location is fifteen feet wide.
It is the only vehicular access for all lots on Seal Way (which front on the
beach). To adequately serve the traffic generated by this area (particularly
as density is increased by apartment additions such as the one here proposed)
a twenty-five foot wode travel way and public utility area should be developed.
The additional width required should be obtained equally from land located
on each side of the alley. Therefore, as a condition of this var~ance (which
allows additional development) a five foot wide easement for public alley and
public utility purposes should be dedicated to the City of Seal Beach across
the rear of subject lot adjacent to the existing alley line.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance No. V-12-67 subject to the conditions and
requirements stated in the findings above. This variance shall not become
effective until the five foot wide strip, mentioned in finding number seven above,
has been granted to the City of Seal Beach and has been recorded.
