HomeMy WebLinkAboutPC Res 135 - 1967-07-19 . . . e e RESOLUTION NO. 135 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING- VARIANCE FOR ENCROACHMENT INTO THE REAR YARD OF A PATIO COVER AT 4909 HAZELNUT AVENUE WADE BROWN, V-13-67) WHEREAS, in the matter of Variance Application No. V-13-67, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by Wade Brown, 4909 Hazelnut Avenue, Seal Beach. 2. Subject property is located at above address and is described as Lot 159 of Tract 5961. 3. Subject request is for construction of a patio cover intruding into the required rear yard in a R-l Zone. Rear yard requirement for this location is 15 feet due to tentative map criteria. Patio cover is 6 feet from rear line at one corner and 8 feet from rear line at other corner. WHEREAS, the Planning Commission findings are as follows: 1. Normal R-l rear yard set back is 10 feet. 2. This case is one of inadvertance in that the patio contractor indicated incorrect distances from the house to the rear line on his building permit application drawings. The discrepancy was discovered by the building department at the time of final inspection. The patio cover has been completely constructed. 3. Subject patio cover is of substantial quality and should not be detrimental to property values in the neighborhood. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-13-67 subject to the following conditions: 1. Granting of this variance is because of the inadvertant construction of the patio and this action shall not be considered as a precedent for general application for rear yard encroachment. 2. Subject structure shall be maintained as a patio roof only. Construction of walls shall void this variance and it shall be then considered as rescinded.
