A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH DENYING VARIANCE
APPLICATION V-16-67, ENCROACHMENT INTO
FRONT YARD SETBACK (WILFRED J. MCKINNON)
WHEREAS, in the matter of Variance Application No~ V-16-67, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case was initiated by Wilfred J. McKinnon, 121 Stanford Lane, Seal Beach.
2. Subject property is located at above address and is described as Lot 170 of
Tract 5847.
3. Subject request is for conversion of existing garage into living quarters
with covered parking furnished elsewhere on the property. Living area would
encroach into front yard setback 5 feet at narrowest point.
WHEREAS, the Planning Commission findings are as follows:
1. Normal R-l front yard setback is 18 feet.
2. Zoning ordinance prohibits building of living quarters in the required front
yard.
3. By Section 1810.2 of the Code, side entry garages only are permitted to
encroach into required front yard.
4. Allowing conversion of such side entry garages to 1iving quarter. uses would
establish an undesirable precedent and would encourage requests by others for
encroachment of living quarters into required front yards.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby deny Variance Application No. V-16-67.
