RESOLUTION NO. 149 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING VARIANCE APPLICATION V-18-67, ENCROACHMENT INTO FRONT YARD SETBACK (MYRON L. BAKER) WHEREAS, in the matter of Variance Application No. V-18-67, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by Myron L. Baker, 1235 Catalina, Seal Beach. 2. Subject property is located at above address and is described as Lot 100 of Tract No. 1817. 3. Subject request is to permit construction of living quarters over existing garage. Living quarters would encroach approximately 6 1/2 feet into front yard setback. WHEREAS, the Planning Commission findings are as follows: 1. Normal R-l front yard setback is 18 feet. 2. Zoning Ordinance prohibits building of living quarters in the required front yard. 3. By Section 1810.2 of the Code, side entry garages only are permitted to encroach into required front yard. 4. Allowing lIving quarters to encroach into front yard would establish an undesirable precedent and would encourage similar requests by others. 5. Protests were received orally from Mr. Hauth, 1315 Catalina and Dr. Kendid, 1230 Catalina, based on concern of setting precedent and desire to preserve appearance and high quality of area. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby deny Variance Application No. V-18-67.
