RESOLUTION NO. 161
A RESOLUTION OF THE PLANNING CO~IISSION OF
TIlE CITY OF SEAL BEACII APPROVING A VARIANCE
FROM SECTIONS 1801 AND 1802 OF ZONING
ORDINANCE NO. 628 AND FROM CITY CODE SECTION
21-8 (SUBDIVISIONS) TO DIVIDE A PARCEL INTO
A ~fAXlMUM OF FOUR LOTS WHICH ARE SUBSTANDARD
IN WIDTH AND AREA. (SUPERIOR OIL COMPANY.
VARIANCE NO. V-24-67).
WHEREAS. in the matter of variance application No. V-24-67. the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case was initiated by Superior Oil Company. 1801 Avenue of the Stars.
Los Angeles. California. by its Assistant Secretary, Paul A. Lower.
2. Subject property is located on the beach front side of Ocean Avenue at First
Street. being a portion of Block liB" of Bay City and being more fully described
in attached Exhibit "A".
3. Subject request is to allow subdivision of the existing parcel into not more
than four lots. minimum lot width request of 30 feet. The total frontage
width of this parcel is 136 feet. The zoninR is R-l. and ~ chanRe of zone
classification is requested.
4. Variance is required to the provisions of Sections 1801 and 1802 of the Zoning
Ordinance (628)and to Subdivision Provisions of City Code Section 21-8. These
sections require that minimum lot area shall be 7000 square feet for New R-l
lots, and minimum lot width shall be 70 feet.
5. The Planning Commission has the authority to grant variance to the provisions
of the Zoning Ordinance and the City Council has the authority to grant variance
to the ~rovisions of Article 21 (Subdivisions) of the City Code.
'~EREAS. the Planning Commission findings are as follows:
1. Existing use along the beachfront side of Ocean Avenue is sinRle family resi-
dents on lots ranging in width from 25 feet to 50 feet. with most being of 30
to 35 foot width.
2. A blanket agreement is in force among all owners along this portion of Ocean
Avenue except for the subject lot. This agreement includes various re-
strictions on buildings and parcels. Among these restrictions are the follow-
ing:
(a) Each building site must be at least 30 feet in width,
(b) No building shall be projected in a seaward direction past a buildinR
restriction line which is parallel to Ocean Avenue and is 100 feet to-
ward the ocean from the southwesterly side of Ocean Avenue,
(c) All building plans must be submitted to a property owners' building
Committee.

3. A ten foot wide easement for public utility purposes (water and sewer) is re-
quired across subject land to provide necessary service. Location of said
easement is parallel to and lyinp along the seaward side of the building re-
striction line stated in finding No.2 above (100 feet from Ocean Avenue).
This easement is the northwesterly projection of the present utility easement
servin~ adjacent properties.
4. A number of verbal protests were heard RS well as a number of verbal state-
ments of support.
5. Proposed division of land is in basic conformance with the neighborin~ area and
is reasonable providing that future building is controlled by process of re-
view.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance No. V-24-67 in regard to provisions of Sections
1801 and 1802 of the Zoning Ordiance (628), and does hereby recommend to the City
Council of the City of Seal Beach approval of variance to Section 21-8 Subdivision
requirements of the City Code, all subject to the following conditions:
1. No more than four single family parcels shall be subdivided from subject property.
2. Minimum lot width of any building parcel shall be 30 feet.
3. Minimum width of corner lot lyin~ adjacent to the extension of rirst Street
(entrance to City Parking Lot) shall be 34 feet.
4. No structures shall be constructed seaward of a line parallel to the south-
westerly line of Ocean Avenue and 100 feet therefrom.
5. A 10 foot wide public utility easement, as stated in findin~ No. J above,
shall be dedicated to the City of Seal Beach before any subdivision of sub-
ject property shall be effective or any building permit issued.
6. Actual subdivision and use of subject property shall be subject to all
applicable provisions of the Zoning and Subdivision Ordinances except those
provisions from which variance has been granted.
7. Prior to issuance of any ~uilding permit for construction upon any site sub-
divided from subject property, the proposed building plans shall be sub-
mitted to the Planning Commission for Plan Review. Said plans shall also
be submitted for comment to the property owners building committee mentioned
in finding No. 2 above, c/o Willis Davi~550 Ocean Avenue, Seal Beach. Com-
ments of said building committee shall be considered by the Planning
Commission at the time of said Plan Review.
