RESOLUTION NO. 167
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH REAFFIRNING ITS
DENIAL OF VARIANCE APPLICATION NO. V-16-67
AND RETURNING IT TO THE CITY COUNCIL FOR
FINAL ACTION. (McKINNON).
~IEREAS, in the matter of variance application No. V-16-67, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject application is for conversion of existing garage into living quarters
for encroachment into the required front yard setback at 121 Stanford Lane,
Lot 170 of Tract 5847.
2. By Resolution No. 148, the Planning Commission denied this application for
variance. Mr. McKinnon subsequently appealed this decision to the City
Council of the City of Seal Beach. On October 2, 1967, the City Council
referred this case back to the Planning Commission with recommendation for
approval of the variance.
WHEREAS, the Planning Commission findings are as follows:
1. No new or additional facts have been presented which warrant changing the
original decision by the Planning Commission.
2. The Planning Commission is quite concerned that variances be granted only for
good and sufficient reasons, consistent with their understanding of OUL zoning
ordinance. To clarify this concern there is attached hereto and made a ~art
of this Resolution as Exhibit "A", the talks entitled "Dangerous Trends in
Zoning - Misuse of Variance Device" and excerpts from "Dangerous Trends in the
Use of The Conditional Use Permit", both of which were presented at a meeting
of the Southern California Planning Congress, August 10, 1967.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby reaffirm its original action denying Variance No. V-l6-67 and
does return it to the City Council for their final action.

I hereby certify that the foregoing resolution was duly adopted at a regular meet-
ing of the Planning Commission of the City of Seal Beach which was held on Wednes-
day, October 4, 1967.
