COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE V-28-67 TO CONSTRUCT A GARAGE WITH THE SECOND STORY APARTMENT ENCROACHING INTO THE REAR YARD SETBACK AND ENTIRE STRUCTURE ENCROACHING INTO EXTERIOR SIDE YARD SETBACK. (ARTARNE) WHEREAS, in the matter of Variance Application No. V-28-67. the Planning Commission of the City of Seal Beach does report as follows: 1. Subject request initiated by Wong Artarne. 380 North Myrtle Ave., Monrovia. 2. Subject property is described as Lot 12. Block 14, Bay City Tract. Street address is 112 14th St., Seal Beach. 3. Subject request is to allow construction of a garage with a second story apartment. Entire structure to encroach 1 foot into the exterior side yard and second story to encroach four feet into the required rear yard. WHEREAS, the Planning Commission findings are as follows: 1. Existing house has three foot exterior side yard. This was constructed legally under a prior ordinance. . 2. A number of similar variances have been granted for the upper story overhang into the rear yard. 3. Exterior side yard and rear yard abut intersecting alleys and could create traffic hazard at corner. Dedication of a corner eight feet on each side to the City would provide clearance for public service vehicles. 4. The proper turning radius into the garage is maintained. NOW. THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance V-28-67 to allow construction of a garage and second story apartment encroaching one foot into the exterior side yard and the second story encroaching four feet into the required rear yard subject to the dedication to the city of a corner measuring eight feet from the intersection of the two alleys along the rear and exterior side yards. Variance shall not become effective until said dedication has been properly recorded.
