V-32-67 TO PERMIT CONSTRUCTION OF A 15 UNIT APARTMENT BUILDING AT 140 10th ST. (M. A. SHARON) lVHEREAS, in the matter of Variance Application No. V-32-~7, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by M. A. Sharon, 709 E. 3rd St., Long Beach, 90812. 2. Subject property is located:at 140 10th St., being Lots 38, 40, 42, Block 10, Bay City Tract. 3. Subject request is to allow construction of a 15 unit apartment building on 3 lots (8,813 square foot area). Maximum allowable units per code is 9.8. A rear yard reduction to 4' is also requested. 4. Three alternate plans are submitted. Alternates A and B each require side yard variances. ~iEREAS, the Planning Commission findings are as follows: 1. The General Plan indicates that increased density in the beach area of the city should be encouraged. 2. The proposed plans are in conformance with the concept of bonus units being allowed as increased parcel sizes atie provided. This will encourage '. accumulation and redevelopment of existing small lots with old, substandard buildings. 3. A similar variance was recently granted for such a building to be located at 11th St. and Central Avenue. 4. The rear yard reduction to 4 feet is acceptable, provided that at least 16 foot wide exit is provided from the parking area. 5. Fire protection must be provided to the satisfaction of the fire chief. 6. Alternate Plan "B" is acceptable if side balconies are reduced to a 2'6" projection from the building line. This is 6" greater encroachment into side yard than allowed by code. Alternate plans "A" and "c" are rejected. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-32-67 to allow construction of a 15 unit apartment building with 4 foot rear yard and side balconies encroaching 2'6" into required 7'6" sideyards, all in conformance with the findings listed above.
