RESOLUTION NO. 176
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SF~L BEACH APPROVING VARIANCE NO.
V-33-67 TO PERMIT CONSTRUCTION OF A NEW GARAGE
WITH UPSTAIRS APARl1ffiNT. APARTMENT OVERHANG
AT REAR TO PROJECT 4 FEET INTO .THE REQUIRED
12 FOOT REAR YARD. 130 DOLPHIN (FRANK SEMASKO)
WHEREAS, in the matter of Variance Application No. V-33-67, the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject case was initiated by Frank Semasko, 130 Dolphin Ave., Seal Beach.
2. Subject property is located at 130 Dolphin Ave., Lot 5, Block B of Tract No.1.
3. Subject request is to allow construction of garage with upstairs apartment
unit. The second story encroaches 4 feet into the required 12 foot rear yard.
WHEREAS, the Planning Commission findings are as follows:
1. Twelve foot rear yard is required primarily to provide for adequate turning
radius for auto exiting from garage.
2. The 12 foot rear yard clearance is provided on this plan at the ground floor
garage level. The only encroachment is at the second story, as a cantilever
projection.
3. A number of similar variances have been granted in the recent past.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve variance No. V-33-67 to allow construction of a
conforming garage with second story apartment to project 4 feet into the required
12 foot rear yard.
