RESOLUTION NO. 183
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH RECOMMENDING THE AMENDMENT
OF ORDINANCE 628 (ZONING) TO REQUIRE THE ISSUANCE
OF A CONDITIONAL USE PERMIT IN ORDER TO ESTABLISH
AN AUTOMOBILE SERVICE STATION USE IN THE C-2 ZONE
WHEREAS, in the matter of the proper location and controls for establishing the
"Automobile Service Station" use, the Planning Commission of the City of Seal
Beach does report as follows:
1. Ordinance 628 (Zoning) presently allows establishment of the use "Service
Station" in the C-2 Zone (G2nera1 Commercial) without Conditional Use Permit.
2. It has been discussed that more effective controls are required in determining
allowable locations for this use.
3. Automobile Service Station use is presently listed as an allowable use in the
C..2 Zone.
4. A public hearing on this matter was held on November 15, 1967.
WHEREAS, the Planning Commission findings are as follows:
1. The "Automobile Service Station" use is unique, and its location requires
special consideration.
2. Improper location of "Automobile Service Station" use can be detrimental to
other uses in the area.
3. "Automobile Service Station" use should continue to be listed under C-2 Zone,
but Section 1100 of Ordinance 628(Zoning) should be amended to require the
issuance of a Conditional Use Permit in order to establish and operate this use.
4. Section 1100 (13) of Ordinance 628 should be deleted as follows:

5. Section 1100 (17)(c) should be inserted in Ordinance 628 as follows:
(c) Automobile Service Station. It is recognized that the proper location of
automobile service stations warrants special consideration because of several
important elements of design and operation that are unique and significant such
as: total dependence on vehicular traffic, distinctive physical appearance,
unenclosed nature of activities and long hours of operation. Improper location
of an automobile service station can be detrimental to other uses in the area.
In considering a request for this use, the following criteria shall govern,
in addition to general criteria listed under Section 2004:
(1) Possible effect on vehicular and pedestrian traffic.
(2) Compatibility with existing or planned uses in the surrounding area,
particularly residential or public use.
(3) The number of existing automobile service stations in the area.

Automobile Service Station use shall also be governed by the detailed
requirements of Section 1835.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby recommend to the City Council of the City of Seal Beach the
amendment of Ordinance 628 (Zoning) as 1ndica~ed in the findings listed above.
ADOPTED AND APPROVED this 15th day of November, 1967.
