RESOLUTION NO. 185 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING THE AMENDMENT OF ORDINANCE 628 (ZONING) TO ADD THE DEFINITION OF "DRIVE-IN RESTAURANT" WHEREAS, in the matter of the definition of "Drive-In Restaurant", the Planning Commission of the City of Seal Beach does report as follows: 1. Ordinance 628 (Zoning) does not now contain a definition of "Drive-In Restaurant". 2. This use is constantly increasing in number of establishments. 3. A Public Hearing on this matter was held on November IS, 1967. WHEREAS, the Planning Commission findings are as follows: 1. Because of difficulty in applying zoning controls to outside oriented food service establishments under the general term "restaurant", it is desirable to provide a more narrowly construed definition. 2. The following definition is considered appropriate: "Drive-In Restaurant - means a retail food service establishment in which all, or a portion of, said food service is to customers remaining in their automobile while on the premises, or in which drive-in customers may park on premises, walk to an outside oriented food service facility and receive or consume food or beverages on the premises but outside of the food service building. This definition includes "Drive-Through" restaurant." 3. Section 226.1 should be inserted in Ordinance 628, containing the definition given in Finding No.2, above. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby recommend to the City Council of the City of Seal Beach the amendment of Ordinance 628 (Zoning) as indicated in the findings listed above.
