RESOLUTION NO. 186
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH RECOMMENDING THE AMENDMENT
OF ORDINANCE 628 (ZONING) TO REQUIRE THE
ISSUANCE OF A CONDITIONAL USE PERMIT IN ORDER
TO ESTABLISH A "DRIVE-IN RESTAURANT" USE IN
THE C-2 ZONE
WHEREAS, in the matter of the proper location and controls for establishing the
"Drive-In Restaurant" use, the Planning Commission of the City of Seal Beach does
report as follows:
1. Ordinance 628 (Zoning) does not include "Drive-In Restaurant" specifically
in the list of allowable uses in any zone.
2. By implication it is included in the C-2 Zone, since Section 1101 "Limitations
or Permitted Uses", in the C-2 Zone, refers to "Drive-In Restaurant".
3. A Public Hearing on this matter was held on November IS, 1967.
WHEREAS, the Planning Commission findings are as follows:
1. The "Drive-In Restaurant" use is not similar in nature to "Restaurant" use
(considered as an inside food service and eating establishment). "Drive-In
Restaurant" use is completely geared to outside oriented service to
a~tomobile drive-up or drive-through trade. This can create many problems
of traffic, unsightliness, littering, disturbing noise, etc., not usual to
the inside "Restaurant" use.
2. "Drive-In Restaurant" use should be listed under the C-2 Zone (General
Commercial), with a Conditional Use Permit required in order to establish
this use.
3. Section 1100 (17) (d) should be inserted in Ordinance 628 as follows:
(d) Drive-In Restaurant. It is recognized that the proper location of drive-
in restaurants warrants special consideration because of several important
elements of design and operation that are unique and significant such as:
total dependence on vehicular traffic, distinctive physical appearance,
unenclosed nature of activities and long hours of operation. Improper location
of a drive-in restaurant can be detrimental to other uses in the area. In
considering a request for this use, the following criteria shall govern, in
addition to general criteria listed under Section 2004:
(1) Possible effect on vehicular and pedestrian traffic.
(2) Compatibility with existing or planned uses in the surrounding area,
particularly residential or public use.
(3) The number of existing drive-in restaurants in the area.

Because of the wide variation in design and operation of this use, the Planning
Commission shall determine the proper number of on-site parking spaces
required for each site for which a Conditional Use Permit is requested.
4. Section 1710 - 5.1 should be inserted in Ordinance 628 as follows:
5.1 Drive-In Restaurant
To be determined by Planning Commission
under Conditional Use Permit
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby recommend to the City Council of the City of Seal Beach the
amendment of Ordinance 628 (Zoning) as indicated in the findings listed above.
