V-3-68 TO ALLOW CONSTRUCTION OF A CONFORMING STRUCTURE WITH A SECOND FLOOR OVERHANG TO ENCROACH FIVE FEET INTO THE RE- QUIRED REAR YARD (TARLTON) WHEREAS, in the matter of Variance Application No. V-3-68, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject request initiated by Mr. & Mrs. Julian Tarlton, 2076 Junipero Street, Signal Hill, California. 2. Subject property is described as Lot 35, Block 6, Bay City Tract, located at 135 Seventh Street, Seal Beach, California. 3. Subject request is to allow construction of a conforming structure with a second floor overhang to encroach five feet into the nine foot required rear yard. 4. Zoning is R3 - Multiple Residential. WHEREAS, the Planning Commission findings are as follows: 1. Similar variances have been granted in the past. 2. The proper turning radius is maintained. 3. A four foot setback would be maintained at upper story level and would not be detrimental to alley traffic. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve V-3-68 to allow construction of a conforming building with a second floor overhang to encroach five feet into the required nine foot rear yard.
