RESOLUTION NO. 204 A RESOLUTION OF TilE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE UV-1-68 TO ALLOW THE CONSTRUCTION AND OPERATION OF A JACK-IN-THE-BOX RESTAURANT IN TilE Cl SERVICE COMMERCIAL ZONE (McFARLAND) WHEREAS, in the matter of Use Variance Application No. UV-1-68, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject request initiated by Violet McFarland, 530 West Broadway, Long Beach, California. 2. Subject property is described as Lots 34, 36, 38,40, 42 and 44, Block 208, Stanton and Lothian's First Addition, located at the South corner of 8th Street and Pacific Coast Highway. 3. Subject request is to allow the construction and operation of a Jack-in-the-Box Restaurant in the Cl Service Commercial Zone. 4. Present use of the property is named the "Surfer Girl A-Go-Go". WHEREAS, the Planning Commission findings are as follows: . 1. The proposed use is an improvement over the existing use. 2. The proposed use is compatible with its location. 3. A USe that is owner-operated tends to result in better maintenance. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Use Variance UV-1-68 to allow construction and operation of a Jack-in-the-Box Restaurant in the Cl ServIce Commercial Zone subject to the following conditions: 1. Drives from which angled or perpendicular parking is located shall be a minimum of 24 feet wide. This will require the intercom station to be moved about 9 feet further from the rear property line. 2. The "finger" type planters separating parking stalls on the 8th Street side shall extend the full length of the parking stalls (i.e., 20 feet). 3. The accessway from 8th Street shall be reduced in width from 35 feet to 28 feet, and the Westernmost planter along 8th Street shall be increased in length to 20 feet. 4. Tire bumpers shall be required in all parking stalls. 5. A planter shall be installed at the front of the building. . 6. All parking stalls shall be striped and shall indicate the true length of the stall (i.e., 20 feet). 7. The radius of the walk and curb at the eastern corner of the building and pad shall be increased from four to seven feet. 8. The maximum height of the pole sign shall be 26 feet. 9. In accordance with the Seal Beach Code there shall be no movin!!, flashing, or revolving aspects to any sign or display. 10. A "specimen" olive tree shall be placed in the planter near the base of the pole sign. 11. The existing sidewalk on both street frontages shall be replaced with a new 4" concrete sidewalk, from curb to property line. Any defective curbing shall be replaced. A 10 foot by 10 foot corner cut-off at the north corner of the parcel sllall be dedicated to the City of Seal Beach, ~ 13. A patterned six foot wall shall be erected upon the southwest property line. Design and construction shall be subject to approval of City Engineer. 14. A planter shall be located next to the 45 degree stall at the north corner of the building. 15. A planter along the alley shall be extended 30 feet southwest. 16. All lighting shall be shielded from casting glare outside the property lines. 17. Four street tree wells shall be installed within the new sidewalk on 8th Street, at locations to be determined by the City Engineer. Trees shall be 15 gallon size Melaleuca leucondendron. 18. Two street tree wells shall be located in front of the building, within the sidewalk on Pacific Coast Highway (same as above). 19. All utilities shall be placed underground. 20. If a selection display board is to be located at the rear of the property, it shall not exceed a height of six feet. 21. There shall be no signs upon the three poles located on or near the planter adjacent to the alley. One sign labeled "Drive Thru" may be placed beneath the overhang over the accessway for food pick-up. ~ 22. All rooftop mechanical features shall be shielded from view. 23. Basic color of the building sh,ll:be"yellow-gold. 24. The intercom station shall be landscaped. 25. Permanent watering facilities shall be provided for all landscaping. 26. The trash storage area shall be enclosed by a wall of similar material as wall along the rear of the property. Entrance to this storage area shall be through a wooden gate. 27. The size and type of plants shall be determined by the City Engineer. 28. The maximum seating capacity within the building shall be 30 persons. 29. The only approved signs shall be: One identification pole sign including an "Entrance" arrow; one selection display at the intercom station; one selection dis- play at the rear property line, or at a location approved by the City Engineer. Three square flush mounted signs upon the upper half of the front and sides of the building; the words "Hamburger" and "Drive Thru" upon the front and two sides of the upper half of the building; and one "Drive-Thru" sign beneath the overhang of the "Pick-Up" accessway. ~ 30. There shall be no external music or voice broadcasting outside the building with the sole exclusion of the intercom station. 31. Final approval is subject to an affirmative vote by the City Council.
