V-5-68 TO ALLOW ONE ADDITIONAL UNIT AND ENCROACHMENT INTO TIlE REAR AND SIDE YARDS. (DENLINGER) WlIEREAS, in the matter of Var1ance Application No. V-5-68, the Plann1ng Commission of the C1ty of Seal Beach does report as follows: 1. Subject case was initiated by Ross B. Denlinger, M.D., 1023 Linden Avenue, Long Beach, Cahfornia. 2. Subject property is described as Lot 18, Block F, Tract 1009. Street address for said property 1S 1201 Seal Way. 3. Subject request is for a 9" encroachment into the required interior sideyard, a 32" encroachment into the required exterior sideyard, the cantilevered second and third stories to encroach l' into the required rear yard, and to allow 4 units instead of 3.75 maximum permitted by lot area. WHERhAS, the Planning commission find1ngs are as follows: . 1. Similar encroachments of upper stories into the rear yard have been allowed in the past. 2. Side entry garage permits more garage space. Two additional parking spaces over minimum requirement are be1ng provided to help re11eve congestion 1n the area. 3. Corner location has more light and air than interior lot. 4. Mary McKinnon, 1203 Seal Way, and O. W. August, owner of 1303 Seal Way, protested encroachment uito the interior sideyard. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-5-68 on thu condition that six parking spaces be prov1ded, one of which may be an interior tandem space, and also on the condit10n that the owner grant to the C1ty of Seal Beach a f1ve foot wide strip of land across the rear of th1s property for future alley widening purposes. Variance shall not become effect1ve unt1l the deed for this str1p of land has been recorded.
