A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH APPROVING VARIANCE NO. V-6-68 TO LOCATE
THE POOL OPERATING EQUIPMENT 2~ FEET FROM PROPERTY
LINE (EATON)
WHEREAS, in the matter of Variance V-6-68, the P1annin~ Commission of the City of
Seal Beach does report as follows:
1. Subject property is owned by Don C. Eaton, 4872 Cand1eberry Ave., Seal Beach.
2. Subject property is legally described as Lot 63, Tract 6421.
3. Subject request is to locate pool operating equipment 2~ feet from the property
line in lieu of the required 5 feet.
WHEREAS, the Planning Commission findings are as follows:
1. Subject lot is smaller than others in the same area and is irregularly shaped.
2. Subject request will not adversely affect the General Plan.
3. Granting this variance will not be detrimental to the public welfare because
it assists property owners to enjoy a substantial right available to others
in this same vicinity and zone.
4. Granting this variance will be beneficial to the adjacent property owners
because this equipment will be located more distant from all neighboring
residences.
5. The pool was partially completed before variance application was made. The
Plannin~ Commission censors such improper action of Automation Pools, Inc.,
Garden Grove, California.
6. Letters indicating approval of the grantin~ of the variance were received
from seven neighborin~ property owners. No objections were received, written
or oral.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance V-6-68 with the condition that the top of the
heater vent is setback five feet from the side property line and two and one-half
feet from the rear property line. In addition, the top of said vent shall not
exceed a height of six inches above the top of the wall.
ADOPTED AND APPROVED this 15th day of ~lay, 1968.
