" ~ ~ , , RESOLUTION NO. 219 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE V-IO-68 FOR POOL OPERATING EQUIPMENT TO BE LOCATED WITHIN THE REQUIRED FIVE FOOT SETBACK FROM PROPERTY LINE (BANER) WHEREAS, in the matter of Variance V-IO-68, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject request was initiated by Charles E. and Lillian Baner, 3611 Teaberry Circle, Seal Beach. 2. Subject property is legally described as Lot 49. Tract 6416. 3. Request is to locate pool operating equipment inside the five foot setback. WlmREAS, the Planning Commission findings are as follows: 1. Subject request will not adversely affect the General Plan. 2. Granting this variance will not be detrimental to the public welfare because it assists property owners to enjoy a substantial right available to others in this same vicinity and zone. 3. Granting this variance will be beneficial to the adjacent property owners because this equipment will be located more distant from all neighboring residences. 4. No objections were received, written or oral. NOW, TIIEREFORE. BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance V-IO-68 with the condition that the top of the heater vent is setback five feet from the side property line and two and one-half feet from the rear property line. In addition, the top of said vent shall not exceed a height of six inches above the top of the wall.
