A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING VARIANCE
NO. V-8-68 TO PERMIT A FOUR FOOT ENCROACHMENT
INTO THE REQUIRED REAR YARD SETBACK; TO PERMIT
THE SECOND STORY TO ENCROACH TWO FEET INTO
THE REQUIRED FIVE FOOT SIDE YARD AND 62.5%
LOT COVERAGE IN LIEU OF THE MAXIMUM 60% LOT
COVERAGE. (WATERS)
WHEREAS, in the matter of the Variance Application V-8-68, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject request initiated by Mildred C. Waters, 211 17th St., Seal Beach.
2. Subject property is legally described as Lot II, Block 219, Tract No. 10
of the Anaheim Bay Tract.
3. Subject request is to permit a four foot encroachment into the required
rear yard setback; to permit the second story to encroach two feet into
the required five foot side yard; and, 62.5% lot coverage in lieu of the
maximum 60% lot coverage.
WHEREAS, the Planning Commission findings are as follows:
~ 1. Many properties nearby have apartments cantilevered over garages.
2. Similar variances have been granted in the past.
3. City officials shall be required to make random inspections of the building
and site to verify that all codes will be complied with.
4. Applicant stated the first floor bedroom in the proposed addition is an
integral part of the rear second floor unit, and will not be rented or used
as a bachelor unit.
5. This variance shall be come null and void if any provisions of this variance
or of the R-2 Zone are not adhered to completely.
6. In the future, if reconstruction of the front unit is requested by applicant
or subsequent property owner, all parking shall gain access from the alley
in accord with the off-street parking requirements. There shall be no curb
cut at the front of the property.
7. This property when used as a duplex apartment will not adversely affect the
General Plan.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance V-8-68 to permit the second story of the
proposed addition to encroach four feet into the required rear yard and two feet
into the required northerly side yard and maximum lot coverage of 62.5% subject
to the conditions as stated in the findings above.
