A RESOLUTION OF TilE PLA~ING COMi'lISSION OF TilE
CITY 0'1' SEAL lIEACII RECO~IENDING A."lENmIENT OF
ORDINANCE 628 (ZOlm;G) BY ADDWG TO SECTION
1713 (1) PART "c" - CURB OPENINGS.
WHEREAS. in the matter of regulating curb openings the Planning Commission of the
City of Seal Beach does report as follows:
.1. The.present ~oning Code does not control curb openings for psrcels served by
alleys.
2. Many residents have complained that curb cuts have seriously r~duced available
on-street par~ing.

3. In the City's R-2 and.R-3 zoned areas. alleys have been provided for vehicular
access to the site.
4. The proposed amendment prOvides that there be no curb openings or curbcuts to
any parcel served by an alley. This amendment: provides an exception for
facilities designed for drive-through ingress and egress together with
appropriate widths for one and two-way traff~c.
. WHEREAS. the Planning Commission findings are as follows:
1. Residential curbcuts vary from ten to f~fteen feet in width.
2. For every curbcut allowed. a curbside parking space is lost.
3.
When the use of curbcuts is repeated lot after lot. the front yards of
properties will become occupied by autos. boats. campers and trailers.

drop in property values will occur.

of curbcuts tend to decrease the use and benefits from alleys.
6. Alleys sre public rights-of-way. not.subject to taxation. but reduce the amount
of land available for taxation. If an alley is not used for the purposes created,
the City in effect. suffers a tax loss for land which otherwise could have been
use~ for buildings. patioR or other open space.

B. This amendment coupled with the :I:9ondlllent regulating the numher of parking
spaces per unit will l'equire each I'ro"ert~. OWnel" to provide sufficient parking
on-site to nccomodate the autctlobUE'!; of the occupants in a manner which will
not be detrimental to the neighborhood.

9. Allowing vehicular access from both the front and rear yards reduces play area
and increases hazards to children.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby recommend to the City Council of the City of Seal Beach the
adoption of an amendment to Ordinance No. 628 (ZoninR) by the addition of Section
1713 (1) Part "c" - Curb Openings all shown in th:! attached Exhibit "A".
