V-24-68 TO PERMIT A FOUR STORY, FOUR-FAMILY UNIT BUILDING WITH SUBSTANDARD SIDEYARDS. (GALLAGHER, DUNN & LAUGHER) WHEREAS, in the matter of Variance Application No. V-24-68, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by T. P. Gallagher, Jacquiline & James W. Dunn, Jr., and Harmon & Luann Laugher, 1501 Seal Way, Seal Beach. 2. Subject property is described as Lot 18, Block G, Tract No. 1009. Street address for said property is 1301 Seal Way. 3. Subject request is for a four story, four fOllOWing exceptions to the Zoning Code. 3.75; (2) Three foot sideyards; (3) Forty 35 foot maximum; and (4) Upper stories to family apartment building with the (1) Four units instead of allowable foot mean heighth in lieu of the encroach into rear yard setback. WHEREAS, the Planning Commission findings are as follows: . 1. Similar encroachments of upper stories into the rear yard have been allowed in the past up to and no closer than two foot from the ultimate right-of-way line. 2. Similar variances have been granted for substandard sideyards for corner lots in this high density area. 3. Fourth story provides for well planned, spacious units which will be a major improvement for the area. . 4. Two protests were made regarding concern over congestion in the area by Mrs. Herron, 1305 Seal Way, and Mr. Legerton, l307~ Seal Way. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-24-68 with the condition that the owners dedicate a five (5) foot wide strip across the rear of the property to the City of Seal Beach for future alley widening purposes, and that the upper story encroachment into the rear yard be no closer than two feet from the future right-of-way line. Variance shall not become effective until the deed for this strip of land has been recorded. ADOPTED AND APPROVED this 18th day of December, 1968. ,; ~,~~ Chairman of the ';( (l _ .I) .
