HomeMy WebLinkAboutPC Res 267 - 1968-12-18 . . . - '. . RESOLUTION NO. 267 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE APPLICATION NO. V-26-68 TO PERMIT CONSTRUCTION OF AN EIGHT UNIT APARTMENT BUILDING WITH SUBSTANDARD SIDE YARDS ADJACENT TO THE GARAGE AREA ON THE REAR OF THE PROPERTY AND UPPER STORY ENCROACHING INTO THE REAR YARD. (WARD) WHEREAS, in the matter of Variance No. V-26-68, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case was initiated by David K. Ward, 1855 Pacific, Long Beach. 2. Subject property is described as Lots 39 and 41 and the northerly 1/2 of Lot 37, Block 5, Bay City Tract. Street address is 139 6th St. 3. Subject request is to construct an eight unit apartment building with four foot sideyards adjacent the the garage area in the rear of the property and with the upper story encroaching into the rear yard. WHEREAS, the Planning Commission findings are as follows: 1. Similar encroachments of upper stories into the rear ysrd have been allowed in the past up to and no closer than two foot from the ultimate right-of-way line. 2. Four foot side yards adjacent to the rear garages will provide six garages abutting the alley and two garages abutting the street. This enables the owner to construct a much better appearing building. These sideyards will provide sufficient space for occupant and emergency access. The balance of the sideyards will meet or exceed the minimum code requirements. 3. No protests, written or oral, were received. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance No. V-26-68 as submitted.
