UV-1-69 TO PERMIT A RESTAURANT WITH ON-SALE LIQUOR LICENSE IN A C-l ZONE. (COMMINOS) I .~..' WHEREAS, in the matter of Use Variance application No. UV-1-69, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject application was made by Michael W. Comminos, 4132 Woodruff, Lakewood, California. 2. Subject property is described as Lots 27 through 36, Block 216, Tract No. 10. Street address is 1600 Pacific Coast Highway, Seal Beach. 3. Subject proposal is to establish a restaurant with on-sale liquor in a C-l Zone. WHEREAS, the Planning Commission findings' are'as follows: 1. Proposed location had previously been used 'as a restaurant with on-sale liquor with no detriment to the neighborhood. 2. Proposed use would be primarily an eating establishment. No entertainment of any type is propos~d. 3. Applicant stated he is mainly 'interested in restaurant business. He has in the past and presently operates 'other similar type restaurants only some of which have on-sale liquor. 4. No protests, written or oral, were received. 5. This is a highway oriented commercial use and would not be detrimental to the General Plan. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby ,approve Use Variance No.' UV-1-69 subject to the,,. following conditions: 1. : This use shall be and must remain primarily a restaurant and secondarily an ~n-sale liquor establishment. 2. This Use Variance 'is approved solely for Mr. Comminos and not transferable to a new owner. 3., ,This approval is for the use only. Final building, identification sign, , landscaping and parking plans are subject to plan review by the Planning , C9mmission. I~O(), -p (! 'tiu.J?I. . . . ,. '.. . Resolution No. 280 - 2 . 4. The Use Variance shall be effective only' for a period of one (1) year from date of approval by the City Council. At the conclusion of that time a renewal application shall be submitted by the owner of record of the business. Renewal of the Use Variance shall be subject to investigation and review of the operation by the Planning Commission to determine conformity to the conditions of the Use Variance, effect on the neighborhood, number and type of police reports. 5. In accordance with Planning Commission'policy adopted January 13, 1964, this Use Variance shall not become effective until affirmed by the City Council of the City of Seal Beach.
