RESOLUTION NO. 282
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING VARIANCE
NO. V-3-69 FOR A sn;,_ FOOT ENCROACHMENT OF
THE SECOND FLOOR INTO THE REAR YARD SETBACK.

WHEREAS, in the matter of Variance No. V-3-69, the Planning Commission of the
City of Seal Beach does report as follows:
1. Subject request initiated by Mr. Henry M. Espoy, 1629 Seal Way, Seal Beach.
2. Subject property is legally described as Lots 44, 46 and 48, Block II,
Bay City Tract and located at 144 11th St., Seal Beach.
3. Subject request i~ for a six foot encroachment of the second floor into the
.rear yard setback and a three foot exterior sideyard in lieu of the required
four foot sideyard.
WHEREAS, the Planning Commission findings are as follows:
1. Similar variances have been permitted in the past for second story encroachments
into the rear yard.
2. No written complaints were rec~ived.
3. If the corner parcel is widened by one foot no variance is needed for the
exterior sideyard.
4. A rear yard encroachment will not adversely affect the,General Plan.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Seal Beach does hereby approve Variance No. V-3-69 for a sixcfoot encroachment
of the second story into the required rear yard provided applicant files with
the City Engineer for a lot split to subdivide these parcels into two lots,
twenty-eight (28') foot and forty-seven (47)) foot wide respectively. The
apartment structure on the corner lot shall have a four foot exterior sideyard.
ADOPTED AND APPROVED this 5th day of February, 1969.

I hereby certify that the foregoing resolution was duly adopted at a meeting of
the Planning Commission of the City of Seal Beach which was held on the 5th day
