V-7-69 TO PERMIT A FIVE FOOT ENCROACHMENT OF THE SECOND FLOOR INTO THE REAR YARD SETBACK AND FOR A FIVE FOOT SETBACK ON THE EXTERIOR SIDE PROPERTY LINE IN LIEU OF THE REQUIRED SIX FOOT SETBACK. (JESSNER) WHEREAS, in the matter of Variance No. V-7-69, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject request initiated by Ron Jessner, 253 B 17th St., Seal Beach. 2. Subject property is legally described as the north 23 feet of Lot 20, Lot 22, Block 211, Bay View Tract, and located at 322 and 322~ 11th St., Seal Beach. 3. Subject request is for variance to permit the second story to cantilever five feet into rear yard setback and for a five foot setback along the exterior side property line in lieu of required six foot setback. WHEREAS, the Planning Commission findings are as follows: 1. One written protest was received concerning decreased vision creating a hazard. 2. A one foot encroachment along the exterior side yard would result in decreased traffic safety vision at this corner. 3. A school and playground is across the street with many children crossing in this vicinity. 4. Cantilever of second story into rear yard has been granted in the past. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach approve Variance No. V-7-69 for a five foot rear overhang of the second story and for a four foot interior side yard provided the minimum exterior side yard of six feet is maintained.
