RESOLUTION NO. 313
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING VARIANCE APPLICATION
NO. V-15-69 TO PERMIT THE SECOND STORY TO ENCROACH
INTO THE REAR YARD AND THE OFF-STREET PARKING
AREA TO ENCROACH INTO THE SIDEYARDS. (CLINTON)
WHEREAS, in the matter of variance application No. V-15-69, the Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case was initiated by F. E. Clinton, 1517 Seal Way, Seal Beach.
2. Subject property is described as Lot 22 and the westerly 6.55 feet of Lot 21,
Block E, Tract No.1.
3. Subject request 1s for a variance to allow construction of a three space
carport with provision for construction of a second story apartment above.
Second story to encroach into rear yard four feet. Open sided carports
to encroach into sideyards to provide required parking.
WHEREAS, the Planning Commission findings are as follows:
1. Similar encroachment of upper stories into the rear yard ha~e been approved
in the past.
2. There is insufficient width of the lot for the owner to provide minimum
required parking and minimum required sideyards. Open sided carports would
encroach into the sideyards, but provide necessary parking as well as
emergency access.
3. Seal Way Alley, to the rear of the subject property is twelve feet wide.
It is the only vehicular access for all beachfront lots on Seal Way. To
adequately serve the traffic generated by this area as density is increased,
a twenty-five foot wide travel way and public utility area must be developed.
The additional width required should be obtained equally from land located
on each side of the alley. Therefore, as a condition of this variance a
six and one-half foot wide easement for public alley and public utility
purposes shall be dedicated to the City of Seal Beach across the rear of
subject property adjacent to the existing alley line.
4. No protests, written or oral, were received.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Variance No. V-15-69 as amended and subject to the
conditions that the carports remain unenclosed for emergency access and an
easement ss stated,'in':Findings'.Nd. 5 be granted. to. the City and properly recorded.
ADOPTED AND APPROVED this 19th day of March, 1969.
