RESOLUTION NO. 321 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH ESTABLISHING THE POLICY TO IMPROVE COMMUNITY APPEARANCE BY THE STRICT APPLICATION OF ORDINANCE NO. 748 TO THE DEVELOPMENT AND OPERATION OF AUTOMOBILE SERVICE STATIONS AND BY ANY OTHER LAWFUL AND EFFECTIVE MEANS WHICH MAY BE DEVELOPED. WHEREAS, in the matter of improvement of community appearance the Planning Commission of the City of Seal Beach does report as follows: 1. The City should strive for upgrading its appearance, public and private, to the greatest degree possible. 2. Many methods are being used' to move forward with such improvement, such as: (a) Semi-annual connnunity clean-up-week, with all debris hauled away by city forces. (b) Abatement of weeds, debris, etc. from vacant lots. (c) City construction of special landscaping at key locations and along arterial highways. . (d) Requirement of landscaping in such developments as Suburbia. (e) Requirement of landscaping at all new commercial locations if at all feasible. (f) Review of all new building plans (except single family and duplex) by the Planning Commission to insure compatibility with community and neighborhood. (g) Review of all new commercial sign applications by the Planning Commission to insure reasonable appearance, height, etc. 3. By Ordinance No. 748, adopted by the City Council on March 18, 1968, Automobile Service Stations were made subject to certain development and operating standards which were intended to result in neat, clean and attractive premises of this type of use, which is in constant public display. WHEREAS, the Planning Commission findings are. as follows: 1. The provisions of Ordinance No. 748 are being applied to the construction of new service stations with very satisfactory results. 2. Resolution No. 321 - 2 3. A number of existing service stations, particularly along Pacific Coast Highway,have not been developed or operated in conformance with these standards. In most cases their appearance is detrimental to the community rather than being a community asset. 4. To date, provisions of Ordinance No. 748 have not been applied to such existing service stations except as stated in Finding No.2, above. 5. The city staff reports that developers of new stations and operators of existing stations which are about to be remodeled are resistive to compliance with our standards on the basis that existing station operators thus are given special privilege and advantage by escaping such requirements. 6. It is probably not feasible to impose a requirement for new site landscaping on existing service stations unless they have applied to the City for permission for on-site construction. This is also the case in regard to maximum sign area limitations for existing signs permanently attached to a structure. 7. It would appear feasible and proper to enforce all other provisions of Ordinance No. 748 in respect to all service stations in the community at all times. This would include removal of all portable signs, general site clean-up of trash, debris and merchandise displays, and affixing of price signs to permanent structures (at least 7 feet above ground). NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby adopt and promulgate as its policy that all provisions of Ordinance No. 748 be strictly enforced upon all new automobile service stations and all stations requesting permission for remodeling or renovating, and that provisions of Ordinance No. 748, except those noted in Finding No. 6 above, be applied to all existing service stations.
