RESOLUTION NO. 382
A RESOLUTION OF TIlE PLANNING COMMISSION OF
TIlE CITY OF SEAL BEACH APPROVING USE VARIANCE
NO. UV-11-69 TO PERMIT AN EATING ESTABLISHMENT
WITH COCKTAIL LOUNGE AND ENTERTAINMENT IN A
C-l ZONE. (TRAMA)
WHEREAS, in the matter of Use Variance application No. UV-11-69, the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject application was made by Peter J. Trama, 1017 Pacific Coast Highway,
Seal Beach, California.
2. Subject property is described as 1017 Pacific Coast Highway, located within the
Seal Beach Shopping Center.
3. Subject proposal is for renewal of a Use Variance for an existing restaurant
with cocktail lounge in the C-l Zone. It is proposed to be a dinner house
type restaurant, with entertainment, consisting of a "combo" of no more than
three (3) musical instruments.
WHEREAS, the Planning Commission findings are as follows:
1.
Primary concern of nearby residents is that the business may function
primarily as a bar rather than a restaurant. Applicant stated the Alcoholic
Beverage Commission will grant this license only for a restaurant and that
he must provide five (5) separate full-course dinners.
2. Mr. Trama stated this operation will be a dinner house with entertainment.
3. The following conditions are necessary to afford protection to the neighbor-
hood and to prevent the possibility of the operation becoming primarily an
on-sale liquor business.
a. This use shall be and must remain primarily a restaurant and only
secondarily an on-sale liquor establishment.
b. Total bar seating shall be restricted to a maximum of twelve (12) seats.
c. The rear door of the business shall be an emergency exit only and shall
not be used as a customer entrance and exit. This is to prevent nuisance
to the residential area located across Bolsa Avenue from the rear of the
building. Such rear door shall be equipped with a panic bar and designated
as an emergency exit only. It was noted that during the past year this
rear door was often observed to be open. Mr. Trams stated that he would
make sure that it stayed closed.
d. Use Variance approval is solely to Mr. Trama, if business is sold the
new owner must resubmit a separate use variance application.

The Use Variance Permit shall be effective only for a period of one (1)
year from date of approval by the City Council. At the conclusion of
that time a renewal application shall be submitted by the owner of record
of the business. Renewal of the use variance shall be subject to investi-
gation and review of the operation by the Planning Commission to determine
conformance to conditions of the use variance, effect on the neighborhood,
amount and type of police records, etc.

f. Entertainment shall consist of not more than three (3) musicians with
three (3) musical instruments.
g. In accordance with Planning Commission Policy adopted January 13, 1964,
this use variance shall not become effective till approved by the City
Council of the City of Seal Beach.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Use Variance No. UV-11-69 permitting the above described
use subject to conditions listed above.
