RESOLUTION NO. 386
A RESOLUTION OF THE PLANNTNG COMMISSTON OF THE CITY
OF SEAL BEACH APPROVING VARIANCE V-38-69 TO ALLOW
TANDEM PARKING TO NEET THE OFF-STREET REQUIRLNENT
AND A REAR YARD ENCROACHI1FNT OF THE lmCONn f>TORY.

I~EREAS. in the matter of Variance Application No. V-38-69 the Planning
Commission of the City of Seal Beach does report as follows:
1. f>ubject case was initiated hy Nr. and Mrs. Willi~ Durnin, 1757 Pacific
Avenue, Long Beach.
2. Suhject property described as Lot 38, Block 7, Bay City Tract.
3. Subject request is for tandem parking to he acceptable as required
off-street parkin~ and a one foot encroachment into the rear setback
of the second story.
WHEREAf>, the Planning ComMission findin~s are as follows:

1. A three bedroom unit requires two on-site spaces and a one bedroom
unit requires l~ on-site spaces per code. The total parking requirement
is four. This is physically impossihle on a 25 foot lot unless tandem
spaces are provided since front curb cuts are not allowed.
2. A one foot encroachment into the required nine foot setback is a reason-
able request, considering the small area of the lots.
3. No protests were received.
NOW, THEREFORE, BE IT REf>OLVED, that the Plannin~ Commission of the City
of Seal Beach does hereby approve Variance V-38-69 with the condition that
a Land Use Agreement stipulatin~ that the tandem spaces would remain open
and accessible for vehicle use only, be recorded and filed with the City
Clerk.
ADOPTED AND APPROVED this 17th day of December, 1969.
