RESOLUTION NO. 495
A RESOLUTION OF TIlE PLANNING COMMISSION OF TIlE
CITY OF SEAL BEACIl APPROVING MIENDED USE VARIANCE
APPLICATION NO. UV-5-70 TO PERMIT TIlE CONSTRUCTION
OF A SEVEN UNIT APARTIIENT ON C-2 ZONED PROPERTY
LOCATED ON TilE SOUTlI\~ST CORNER OF 4th STREET
AND MARINA DRIVE. (CUTHBERT JACKSON/BILL GEARHART)
WHEREAS, in the matter of amended Use Variance Application No. UV-5-70, the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject case was initiated by Bill Gearhart, P.O. Box 1632, Huntington Beach,
the authorized agent for Cuthbert Jackson, 4213 Gundry, Lon~ Beach.
2. Subject property is described as Lot 9, Tract 1084, located at the southwest
corner of 4th Street and Marina Drive.
3. Subject is proposing the construction of a seven unit apartment development
on property which is zoned C-2, General Commercial, requiring a use variance.
An additional variance for building height is also requested.
mlEREAS, the planning Commission findings are as follows:

1. Resolution No. 484 of the Planning Commission denied a request for a proposed
eight unit development on the property. The applicant appealed this decision
to the City Council and made modifications in the plan. This matter was
referred back to the Planning Commission as an amended application.
2. The lot is irregular in shape with an area of approximately 7,500 sq.ft. The
density provisions of the Code would allow eight units to be developed on the
parcel if other requirements were met (parking, setbacks, height).
3. There are still a number of commercially zoned parcels available for development
within the City, and all properties surrounding the proposed development are
used for residential purposes.
4. Twelve letters and several comments favored the proposal. There were also
a nu~ber of oral protests made against the development.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve Use Variance UV-5-70 subject to the conditions that
(1) the height of the building be restricted to 35 feet, (2) that the applicant
submit a revised elevation of the building and modified parking pattern for Plan
Review, and (3) that the City Council affirm this approval. _,

meeting of the Planning Commission of the City of Seal Beach which was held on
Wednesday, October 21, 1970, and carried by the following vote:
