DISCUSSION: MITIGATED NEGATIVE DECLARATION OS-3 - FIRE STATION 48 REPLACEMENT PROJECT: Project Overview: Fire Station 48 Replacement Project Location: The proposed Fire Station 48 Replacement Project is located on a triangular shaped property located at the confluence of Seal Beach Boulevard and Beverly Manor Road and southerly of the City of Seal Beach Beverly Manor Water Reservoir, a 2.6 million gallon domestic water reservoir. The existing Fire Station 48 is oriented to face Beverly Manor Road and is immediately east of the Country Villa Retirement Home and approximately 700 feet south of the I-405 Freeway and Seal Beach Boulevard interchange. The site is triangular in shape with a hypotenuse length of about 470 feet along Seal Beach Boulevard by 277 feet (height) on the north and 384 feet (base) on the west adjacent to Beverly Manor Road. The site is currently occupied by the current Fire Station 48 facilities and totals 57,705 square feet. Access to the site is from Beverly Manor Road. No access is available from Seal Beach Boulevard due to the grade differential of the property and roadway, as the Seal Beach Boulevard overpass Agenda Item M Page 2 over the I-405 Freeway is in a transition slope to the intersection of Seal Beach Boulevard and Beverly Manor Road. The Site Vicinity Map is shown in Figure 1, and the Existing Fire Station 48 Site Layout is shown in Figure 2, respectively, of the document. The Proposed Fire Station 48 Replacement Site Layout is shown in Figure 3 of the document. Statement of Need/Project Description: The new fire station will replace a 40-year old facility that is in a gradual state of deterioration, and will encompass 12,987 square feet, approximately 7,900 square feet larger than the current Fire Station 48 facility. Over the past 2 fiscal years Station 48 emergency personnel have responded to the following numbers of calls: Type of Call Fires Ruptures Medical Aid Haz Mat Service Good Intent False Alarm Other Total Station 48 Calls for Service 2006-2007 & 2007-2008 Fiscal Year 2006-2007 Fiscal Year 2007-2008 97 12 4,746 71 282 504 45 2 5,759 Total 195 18 9,838 116 574 996 98 4 11,839 98 6 5,092 45 292 492 53 2 6,080 The increase in medical aid calls from 4,746 to 5,092 represents an approximate 7% increase in calls for service, with the large majority of calls being from the adjacent Leisure World retirement community. This level of request for medical aid is expected to continue to increase over time. The proposed Fire Station 48 Replacement project consists of an approximately 12,987 square foot building designed to address current and future needs of the Orange County Fire Authority to provide appropriate levels of emergency response personnel. The new station also provides a "training facility" that may be utilized by the City of Seal Beach for various training functions, including serving as a back-up Emergency Operations Center (EOC) if the main EOC facility at the Seal Beach Police Department is not operational due to an earthquake or other natural disaster event. The building is proposed to provide 3 apparatus bays, sleeping facilities for 10 fire personnel, and a 1,430 square foot "training room" with kitchen and restroom facilities that are independent of the Page 3 main fire station facilities. The current facility provides 2 apparatus bays and sleeping facilities for 6 fire personnel. These facilities will allow for an increase of service vehicles and emergency response services over that currently provided at Fire Station 48. Other facilities included within the Main Station structure are a public lobby, two captain's offices, an engineering office, kitchen/dining room, exercise room, library/study, related restrooms, medical and tool storage, central storage and laundry facilities. The 1,430 square foot "training facility" will comprise a large meeting/training room able to serve as an alternate EOC location, with kitchen, restroom and storage facilities. Existing General Plan, Zoning and Other Land Use Regulations: A. City of Seal Beach: The City of Seal Beach General Plan land use designation and the Seal Beach zoning designation for the site is Public Land Use/Recreation (PLU/R). Current Zoning Code (Chapter 28. Seal Beach Municipal Code) Designation: The current zoning designation for the site is Public Land Use/Recreation (PLU/R). The PLU/R zone allows as permitted uses "All buildings and facilities owned or operated by the city, county, state, United Stated Government ands special assessment districts provided such buildings and facilities are used for public purpose". The proposed fire station facility is in compliance with the current zoning code. The proposed replacement of an existing fire station with a new fire station is consistent with applicable City land use plans and policies. The project is not located in the Coastal Zone and is not subject to the California Coastal Act. B. Other Permits Required. Other permits required of the project but not under the discretion of the City of Seal Beach include: ^ Approval of a General Construction Activity Storm Water Permit (Regional Water Quality Control Board). Projects that disturb 1 or more acres of land area are required to obtain coverage under the General Permit for Discharges of Storm Water Associated Page 4 with Construction Activity (General Permit) from the Regional Water Quality Control Board. Summa of Miti ated Ne ative Declaration Pre aration and Public Review Process: The Mitigated Negative Declaration for the Fire Station 48 Replacement project has been prepared by, reviewed, and approved by city staff prior to public distribution, and has completed the required 30-day time period for receipt of comments. Comments were received by the City from October 1 to October 31, 2008, in accordance with the provisions of the California Environmental Quality Act. A copy of the subject document has previously been provided for the information of the City Council. The Initial Study, proposed Mitigated Negative Declaration, and required public notices are on file at the Department of Development Services. The Initial Study/Mitigated Negative Declaration was distributed for review and comment to the following agencies and organizations: ^ State of California Office of Planning and Research ^ County of Orange -County Clerk ^ County of Orange -Public Facilities and Resource Department ^ Regional Water Quality Control Board -Santa Ana Region ^ South Coast Air Quality Management District ^ Southern California Association of Governments ^ Army Corps of Engineers -Los Angeles District ^ California Department of Fish & Game -Region 5 ^ U.S. Fish and Wildlife Service ^ Orange County Sanitation District ^ Caltrans District 12 ^ Naval Weapons Station Seal Beach ^ Joint Forces Training Base Los Alamitos ^ City of Long Beach ^ City of Los Alamitos ^ City of Garden Grove ^ City of Huntington Beach ^ City of Westminster ^ Gabrielino/Tongva Tribal Council ^ Gabrielino/Tongva Tribal Council of the Gabrielino Tongva Nation ^ Gabrielino Tongva Indians of California ^ Golden Rain Foundation ^ Orange County Fire Authority The Notice of Intent to Adopt a Mitigated Negative Declaration was published in the local newspaper, The Sun, on October 2, 2008. Copies of the Mitigated Negative Declaration were also made available for public review at the Development Services public counter and at each library within the City. The Page 5 Notice of Intent to Adopt a Mitigated Negative Declaration was also mailed to: ^ Golden Rain Foundation, Attn: Dan Schaeffer ^ Commanding Officer Seal Beach Naval Weapons Station ^ Seal Beach Mutual No. 15 ^ Mitchell Land & Improvement Company The City of Seal Beach received 4 comment letters on the Mitigated Negative Declaration from public agencies and also received comments from the Planning Commission and Environmental Quality Control Board during the public comment period. CEQA section 21091(d)(1) requires that the City, as Lead Agency, must consider any comments on the proposed Mitigated Negative Declaration that are received within the public review period. Pursuant to CEQA, the Lead Agency is only obligated to respond to comments on an Environmental Impact Report, not for a proposed Mitigated Negative Declaration. However, the City does so voluntarily in order to acknowledge public input and fully address any issues raised. Please refer to Attachment 4 to review the "Responses to Comments" document prepared by City staff. Staff Recommendations regarding Negative Declaration 08-3 - Fire Station 48 Replacement Project: The required environmental review process has been completed and the analysis has indicated that the proposed project will not have any significant effects on the environment if the mitigation measures proposed in the IS/MND document are implemented. The California Environmental Quality Act (CEQA) requires that all public agencies establish monitoring and/or reporting procedures for mitigation measures (MMs) adopted as conditions of approval in order to mitigate or avoid significant project impacts. Specifically, Section 21081.6(a)(1) states: "The public agency shall adopt a reporting or monitoring program for the changes made to the project or conditions of project approval, adopted in order to mitigate or avoid significant effects on the environment. The reporting or monitoring program shall be designed to ensure compliance during project implementation." A Mitigation Monitoring Program has been prepared in compliance with the requirements of CEQA, and includes all mitigation measures from the Initial Study/Mitigated Negative Declaration addressing the Fire Station 48 Replacement Project. The Mitigation Monitoring Program also identifies the required timing and responsible parties for implementation and monitoring. The mitigation measures have been sorted by topical area in the order presented in the 1S/MND. A copy of the Mitigation Monitoring Program is provided as Attachment 5 for the information of the City Council. Page 6 Please refer to Section IV, "Explanation of Environmental Checklist Responses" beginning on page 14 and continuing through page 82 of MND 08-3 to review the "Explanation of Environmental Checklist Responses," including the proposed mitigation measures. Mitigation measures are proposed for the following identified areas of concern: ^ Aesthetics -please refer to pages 16 and 17 to review the language of 2 proposed mitigation measures for this area of concern. ^ Air Quality -please refer to pages 26 and 27 to review the language of 1 proposed mitigation measure for this area of concern. ^ Cultural Resources -please refer to pages 32 through 38 to review the language of 4 proposed mitigation measures for this area of concern. O Geology and Soils -please refer to page 43 to review the language of 1 proposed mitigation measure for this area of concern. ^ Hazards and Hazardous Materials -please refer to pages 49 and 50 to review the language of 2 proposed mitigation measures for this area of concern. ^ Hydrology and Water Quality -please refer to pages 56 and 57 to review the language of 3 proposed mitigation measures for this area of concern. ^ Noise -please refer to pages 68 and 69 to review the language of 4 proposed mitigation measures for this area of concern. ^ Transportation/Traffic -please refer to page 75 to review the language of 1 proposed mitigation measure for this area of concern. Staff recommends the City Council adopt a resolution that will memorialize the following determinations of the Council: ^ The City Council hereby affirms that it independently reviewed and analyzed Mitigated Negative Declaration 08-3 and finds as follows: ^ Initial Study/Mitigated Negative Declaration 08-3 -Fire Station 48 Replacement Project was prepared by and approved by city staff prior to public circulation and therefore reflects the independent judgment of the City; ^ There is no substantial evidence in the record that would support a fair argument that approval of the project might have a significant environmental impact; ^ Adoption of the proposed "Mitigation Monitoring Program", dated December 8, 2008 as conditions of approval for the proposed project will mitigate or avoid significant project impacts. ^ Approval of this project involves no potential for adverse effects, either individually or cumulatively, on wildlife resources and will not have an~ adverse impact on fish and wildlife. The project consists of Page 7 demolition of an existing fire station and reconstructing a new fire station at a location with no existing sensitive vegetation or wildlife, and has no impact on wildlife resources, since there are no identified wildlife resources on or adjacent to the site. The City Council directs the Director of Development Services to file the appropriate De Minimis Impact Finding for the California Department of Fish and Game Certificate of Fee Exemption. ^ The City Council approves the "Notice of Determination" and instructs the Director of Development Services to execute and file this document, and any necessary supporting documents in accordance with the provisions of CEQA. The "Notice of Determination" document is provided as Attachment 3. FISCAL IMPACT: None. Approval of Mitigated Negative Declaration 08-3 will allow this project to proceed to preparation of final construction plans and specifications and eventual implementation upon approval of a construction bid by the City Council, and compliance with the adopted Mitigation Monitoring Program. RECOMMENDATION: Adopt Resolution No. 5817, A Resolution of the City Council of the City of Seal Beach Adopting Mitigated Negative Declaration 08-3, Fire Station 48 Replacement Project, and Instructing Staff to File Appropriate Documentation with the County of Orange. The Project has been environmentally reviewed pursuant to the provisions of the Califomia Environmental Quality Act (Public Resources Code Sections 21000, et seq. ("CEQA")), and the State CEQA Guidelines (Califomia Code of Regulations, Title 14, Sections 15000, et seq.). Staff has prepared and circulated an Initial Study/Mitigated Negative Declaration as required by the California Environmental Quality Act (CEQA). The comment period on the subject Initial Study/Mitigated Negative Declaration ended on October 31, 2008. The City received comments on the proposed Mitigated Negative Declaration from: ^ State of California, Governor's Office of Planning and Research -State Clearinghouse and Planning Unit; ^ California Department of Transportation, District 12; ^ County of Orange Public Works Department; ^ Orange County Fire Authority; ^ City of Seal Beach Planning Commission; ^ City of Seal Beach Environmental Quality Control Board. Section 4. Pursuant to Section 15074(b) of the State CEQA Guidelines, the City Council independently reviewed and considered the contents of the Initial Study and the Mitigated Negative Declaration prior to deciding whether to approve the Project. Based on the Initial Study, the Mitigated Negative Declaration, the comments received thereon, the responses to the comments, the Staff Report dated December 8, 2008, additional public comments, and the whole record before the City Council, the City Council hereby finds that the Mitigated Negative Resolution Number 5817 Declaration prepared for the Project reflects the independent judgment and analysis of the City Council and that there is no substantial evidence that the approval of the Project may have any significant environmental impact with imposition of the proposed Mitigation Monitoring Program. The City has addressed each of the stated concerns within the Initial Study/Mitigated Negative Declaration document. Section 5. Although CEQA does not require responses to comments made concerning a mitigated negative declaration, the City responded in writing to comments received. The City has prepared a "Responses to Comments for Initial Study/Mitigated Negative Declaration 08-3 -City of Seal Beach Fire Station 48 Replacement Project," dated November 24, 2008, which document includes written responses to all of the above-received comments on the subject Initial Study/Mitigated Negative Declaration. A copy of that document was provided for the information of the City Council. Section 6. The City Council considered the adoption of the subject Mitigated Negative Declaration 08-3, Fire Station 48 Replacement Project Mitigation Monitoring Program, and Responses to Comments documents, along with a Staff Report on December 8, 2008, and received additional public comments. Section 7. The City has addressed each of the concerns within the Initial Study/Mitigated Negative Declaration document. Section 8. Based upon the foregoing, and based upon substantial evidence in the record before the City Council, the Council hereby: 1. Finds that there is substantial evidence in the record that the project may have a significant effect on the environment, but mitigation measures imposed herein would avoid or mitigate the effects to a point where clearly no significant effect would occur and there is no substantial evidence in the record that any significant effect would remain after mitigation. 2. Finds that there has been no evidence presented that the Negative Declaration has been "substantially revised" so as to require recirculation under the California Environmental Quality Act. 3. Approves and adopts as conditions of approval the Mitigation Measures set forth in "Exhibit A" of this resolution for the Fire Station 48 Replacement Project. Section 9. Based upon the foregoing, and based upon substantial evidence in the record before the City Council, the Council hereby adopts Mitigated Negative Declaration 08-3, Fire Station 48 Replacement Project, and determines that approval of this project involves no potential for adverse effects, either individually or cumulatively, on wildlife resources and will not have an adverse impact on fish and wildlife. Section 10. The foregoing are based on substantial evidence in the record, including without limitation, the draft Initial Study/Mitigated Negative Declaration 08- 3, Responses to Comments, staff reports and both oral and written testimony. The documents that comprise the record of the proceedings are on file with the Department of Development Services, 211 Eighth Street, Seal Beach. The custodian of said records is the Director of Development Services. Section 11. The Council hereby instructs the Director of Development Services to file appropriate documentation with the County of Orange. This shall be done through the excavafion of 1 x 1 m exploratory test urnts (ETUs) placed along transects extending radially from each identified burial or burial cluster. The spaang of the ETUs shall be determined upon consultation with the Project Archaeologist and the MLD. The radial transects shall be designed to test areas within 50 feet (15 m) from the edge of each burial or bunal cluster. Excavation of these units shall be limited to areas contairnng intact cultural deposit (i.e., areas that have not been graded to the underlying undisturbed soil profiles) and shall be excavated until the undisturbed soil profiles are encountered, or to the excavation depth required for the approved grading plan. The soil from the ETUs along the radial transects shall be screened only 'rf human remains are found in that unit. ^ Controlled grading shall be conducted within these 50-foot heightened investigation areas with a wheeled motor grader. The motor grader shall use an angled blade that excavates 1 to 2 inches at a pass, pushing the soil to the side to form a low windrow. Morntors shall follow about 20 feet behind the motor grader, examining the ground for evidence of bunals. At a mirnmum this shall include the soil in the windrow within 50 feet of the burial in the direction of the grading. ^ If additional burials are found during controlled grading, additional ETUs will be hand excavated in the radial patterns described above. Burial Removal and Storage Consultation with the MLD shall occur regarding the treatment of discovered human burials. If the MLD determines it is appropriate to have discovered human remains pedestaled for removal, that activity shall be conducted in a method agreed to by the MLD. ^ After pedestaling or other agreed upon burial removal program is completed, the top of a burial shall be covered with paper towels to act as a cushion, and then a heavy ply plastic wdl be placed over the top to retain surtace moisture. Duct tape shall be wrapped around the entire pedestal, securing the plastic bag and supporting the pedestal. Labels shall be placed on the plastic indicating the burial number and the direction of true north in relation to the individual burial. Sections of rebar shall be hammered across the bottom of the pedestal and parallel to the ground. When a number of parallel rebar sections have been placed this way, they shall be lifted simultaneously, cracking the pedestal loose from the ground. The pedestal shall then be pushed onto a thick plywood board and lifted onto a pallet. A forklift shall carry the pallet to a secure storage area or secure storage containers located on the subject property. ^ If another agreed upon burial removal program is utilized, that method shall be carried out in a manner agreed upon after consultation with the MLD and concurrence by the Director of Development Services. After consultation, and only upon written agreement by the MLD, additional studies that are destructive to the remains may be undertaken, including radiocarbon dating of bone or DNA studies. If the MLD determines that only non- destructive additional studies may be allowed, one shell may be removed from each burial and submitted for radiocarbon dating. The assumption here is that the shell would have been part of the fill for the burial pit, and therefore would provide a maximum age for the burial. ^ The MLD may indicate a willingness to consider some additional exposure and study of the skeletal material removed from the sites. Such study would not involve removal of the remains from the project area, but rather would be undertaken near the storage area. To the extent allowed by the MLD, the bones would be further exposed within the existing pedestals or other medium containing the human remains and additional measurements taken. Consultation with the MLD regarding the feasibility of these additional studies prior to rebunal would occur. Renatnation of Bunals and Associated Artifacts ^ Once all portions of the project area have been graded to the underlying culturally sterile manne terrace deposits, or to the excavation depth required for the approved grading plan, the repatriation process shall be initiated for all recovered human remains and associated artifacts. Once a reburial site has been identified and prepared, the remains and associated artifacts shall be transported from the secure storage area to the site for reburial. Appropriate ceremony will be undertaken during this process at the discretion of the MLD. In considering the implications of the burials in interpreting site use and regional settlement, it is critical to assess the time range represented by the interments. Do they correspond to the full temporal range of site use, or only a limited timeframe? Although direct dating of the bones may not be possible due to the destructive nature of the radiocarbon technique, the MLD may approve the removal of a single shell from the interior of each burial for dating. Although this shall not provide a direct date of the burial, assuming the shell was part of the bunal fdl d should provide a maximum age (that is, the burial should not be older than the shell). In adddion, an equivalent number of addtional samples from non-burial contexts would also be taken for comparative purposes. These data would provde a more secure measure of the intensity of occupation during different periods. ^ Sediment Cores. Dating results obtained to date on the Hellman Ranch/John Laing Homes properties may suggest a possible link between the use of the sites within the project area and the productivity of the ad)acent lagoon and estuary systems. To assess this link using independent environmental data on the sub)ect property, two sediment cores will be taken from suitable locations of the property. Sediments in the cores shall be examined and described in the field by a geologist, and samples collected for dating and pollen analysis. These data shall then be used to help reconstruct the habitats present on the property during the periods the sites were occupied. This analysis shall be included in the final report documenting the testing, data recovery, and construction monitoring phases of this investigation. Analysis of animal interments will include: (1) exposure to determine burial position; (2) photo documentation; (3) examination of skeleton for age/sex; traumatic injury, pathology, butchering, or other cultural modrfcation; (4) radiocarbon dating; and (5) examination of grave dirt for evidence of grave goods or stomach contents. Curation ^ Cultural materials recovered from the cultural resources monitoring and mitigation program for the development shall be curated either at an appropriate facility in Orange County, or, in consultation with the City, at the San Diego Archaeological Center. Preparation of Fnal Report The final technical report shall be prepared and submitted to the City within 12 months of the completion of the archeological field work. The report shall conform to the guidelines developed by the California Office of Historic Preservation for Archaeological Resource Management Reports (ARMR). It will be prepared in sufficient quantity to distribute to interested regional researchers and Native American groups. Draft Mitigated Negative Declaration 08-3, Fire Station 48 Replacement Project -Review of Document and Provisions of Comments. Staff Report Mr. Olivera delivered the staff report. (Staff Report is on file for inspection in the Planning Department) He noted that the City has made a minor revision to the project description and explained that originally the MND reflected that the project would include the temporary relocation of the fire station facilities to the City Maintenance Yard at 1776 Adolfo Lopez Drive; however, the temporary facilities may be at several sites within the City, including, but not limited to, the City Maintenance Yard. He then noted that, pursuant to CEQA guidelines, the change in the project description is an insignificant modification to the MND and does not require recirculation or extension of the public review period. He then introduced David Carmany, City Manager for the City of Seal Beach for a brief PowerPoint presentation. Mr. Carmany explained that the system of care that follows when a resident calls 911 is one of the most important city services provided. He stated that as such, the City must provide proper facilities to ensure that this care is promptly and efficiently provided. He indicated that after completing a thorough assessment of the existing facility it was determined that it required complete replacement to bring it up to current Building Code and Fire Authority standards. He added that because the majority of 911 calls are made from Leisure World (LW) it was decided that the current location is the best for erecting the new fire station. Mr. Carmany then explained that because it would not be feasible to operate out of the existing facility during construction of the new fire station, an alternate location would have to be found. Chairperson Deaton asked what the timeline for completion would be. Mr. Carmany stated that the construction contract is to be for 270 days and after receiving bids the City would like to see construction begin in January 2009. He indicated that the new facility will include a community room that will serve as a back-up emergency operations center. He presented the floor plan and described the proposed facilities noting that the property is to be gated and noted that the design reflects an excellent layout that meets all of the Orange County Fire Authority requirements. Mr. Carmany then introduced Battalion Chief J.J. McMasters, the designated point of contact for the Fire Department throughout this process, and thanked him for his participation. Mr. Carmany then stated that tonight Staff will receive comments from the Planning Commission (PC). City of Seal Beach Fire Station 48 Replacement Project 13 Mitigated Negative Declaration 08-3 Responses to Comments Public Meeting 5: Planning Commission Minutes of October 22, 2008 (Minute Excerpt) -Page 3 Commissioner Eagar asked about the location of the storage fuel structure. Mr. Carmany stated that it would be to the rear of the main building. Commissioner Eager agreed with Commissioner Massa-Lavitt's concerns regarding the widening of the 1-405 overcrossing impinging upon the fire station facility. He also recommended looking into this. Mr. Carmany stated that the City has coordinated ~ 4 these plans with the OCTA to ensure that emergency vehicles will have access to the bridge during construction and it was agreed that, both during and after construction, the center median will be at grade level and marked in paint, rather than being raised, to allow for fire vehicles to use the median to drive over the bridge. Chairperson Deaton asked about permeable asphalt and concrete. Mr. Carman stated that the project will comply in every respect with the new NPDES water quality standards. He emphasized that the rear of the building is basically a functional space and the City chose not to include landscaping to better accommodate service demands and eliminate the need for landscape maintenance in this area. He then noted that because of the weight of the fire 5- 5 vehicles, it is necessary to use concrete for better support, but he would look into whether permeable concrete would work. Chief McMasters commented that he has found the City of Seal Beach to be the strictest when related to NPDES requirements, and does not believe that they would allow runoff issues to develop. Commissioner Delay asked if an auxiliary station on the other side of the bridge during the construction phase was considered. Chief McMasters explained that they have considered various locations, but it is difficult to find a place of sufficient size that is close enough to LW to limit any impacts to response times. 5- 6 Commissioner Delay asked if the proximity to a 50 million gallon reservoir of water would impact the station. Chief McMasters stated that the reservoir is at grade so the water isn't going to come up to the fire station, which lies above grade level. MOTION CARRIED: 5 - 0 AYES: Deaton, Bello, Delay., Eagar, and Massa-Lavitt NOES: None ABSENT: None City of Seal Beach Fire Station 48 Replacement Project 15 Mitigated Negative Declaration 08-3 Responses to Comments Response to Public Meeting 5 Planning Commission Meeting, October 22, 2008 5-1 The comment states a concern regarding possible impacts of the future construction project to widen the Seal Beach Boulevard Overpass at the 1- 405 Freeway. Staff has discussed this matter with the Public Works Director and it has been verified that the Seal Beach Boulevard Overpass at the 1-405 Freeway does not require any additional right-of-way and is not anticipated to begin construction until March 2011. The Fire Station 48 project is anticipated to be completed by December 2009. 5-2 The comment states concerns regarding the determination of staff regarding no impacts of a potential temporary station facility location that has not been specifically identified. At the Planning Commission discussion of October 22, the Commission was provided a supplemental document entitled "Minor Revision to Mitigated Negative Declaration No. 08-3," a copy of which is provided as Attachment 1. The document reviewed the potential impacts of interim station locations within 3 miles of 3131 Beverly Manor Road. The document provided the determination of the Orange County Fire Authority that emergency response times would be improved by the alternative locations. The document also concluded that there would be no additional noise impacts if the interim station were located inside the Leisure World retirement community because the Fire Authority does not employ sirens within Leisure World except when required for public safety. 5-3 The commenter asks several questions that are responded to in the minutes and not repeated again. In addition, the commenter indicates that she feels the MND site plan should show the location of the soils report boring holes. Provided as Attachment 2 is Figure 2 of the "Geotechnical Investigation and Seismic Hazard Evaluation for the Proposed Fire Station #48, Seal Beach, California," prepared by Arroyo Geotechnical, dated March 25. 2008. The figure indicates the boring locations as "B-1"through "B-5." Draft Mitigated Negative Declaration 08-3, Fire Station 48 Replacement Project -Review of Document and Provisions of Comments. Recommendation: Receive presentation from Staff regarding the proposed project and the environmental review process. Receive comments from the public and provide any Board comments regarding proposed Mitigated Negative Declaration 08-3 (MND 08-3). Receive and File Staff Report. He noted that the Board members were provided with a copy of this document for review, and once the public review period ends, Staff will prepare a Response to Comments for all comments received and forward this to City Council (CC), which is scheduled to review this matter at its December 8, 2008, meeting. He continued by stating that the purpose tonight is to receive comments from the EQCB to be included in the Response to Comments that will then be provided to the Board prior to the CC meeting of December Stn The Director of Development Services then briefly reviewed the project noting that after completing a thorough assessment of the existing fire station it was determined that it required complete replacement to bring it up to current Building Code and Fire Authority standards. He stated that the new station would be located generally where the existing station is situated, with the difference that the current station measures 5,000 sq. ft. in size, and the new station would measure approximately 13,000 sq. ft. He explained that the aged building required replacement due to problems with an old roof, mold, and termites. He then provided a brief description of the facility, noting that the new station will include a training room that will also be used as an alternate emergency operations center in case of a natural disaster. Mr. Whittenberg stated that the City is seriously exploring the installation of solar panels on the roof of the building for provision of electrical power. He noted that the MND indicates that temporary facilities would be located at the City Maintenance Yard, but after discussions with the Golden Rain Foundation there may be an opportunity to locate the temporary station within Leisure World (LW), as approximately 85% of the calls for emergency service from this station are for LW. He then provided ~ brief slide presentation of the facility layout noting that the rear parking area is to have a security gate to allow access only to emergency response personnel. Mr. Olivera interjected that the Planning Commission (PC) had commented on the need to use permeable surfaces in this rear parking lot in those areas where the pumper trucks would not normally travel to help lessen water runoff. Mr. Whittenberg stated that this process began approximately one year ago. Member Navarro asked if the facility will have more equipment and personnel than the previous fire station. City of Seal Beach Fire Station 48 Replacement Project 20 Mitigated Negative Declaration 08-3 Responses to Comments Responses to Public Meeting 6 City of Seal Beach Environmental Quality Control Board Meeting Minutes, October 29, 2008 6-1 The comment is regarding the construction impacts of the project on Leisure World. Construction-related impacts are discussed and mitigation measures are proposed in the Air Quality, Hazards and Hazardous Materials, and Noise sections of the environmental analysis. 6-2 The commenter inquires as to why lead is not further discussed in the Air Quality analysis section the MND. In reviewing "Guidance Document for Addressing Air Quality Issues in General Plan and Local Planning," South Coast Air Quality Management District, dated May 6, 2005, the following discussion is quoted regarding Lead: "Lead. Lead (Pb) concentrations once exceeded the state and federal standards by a wide margin, but have not exceeded state or federal air quality standards at any regular monitoring station since 1982. Though special monitoring sites immediately downwind of lead sources have recorded localized violations of the state standard in 1994, no violations were recorded at these stations in 1996. Consequently, the South Coast basin is designated as an attainment area for lead by both the USEPA and CARB." In addition, the maximum monthly and quarterly average Pb concentrations measured anywhere within the South Coast Air Basin during 2007 was at Monitoring Station 11, South San Gabriel Valley, at levels of 0.05 ug/m3 and 0.02 ug/m3, respectively. These measured concentrations are 7.5% and 1.33% of the identified State and Federal standards. The comment is noted. 6-9 The comment states an opinion regarding several issues regarding the noise impacts upon the long-term care facility across Beverly Manor Road from the subject project, concluding that the mitigation measures proposed are not adequate, and that additional mitigation measures are necessary, or that an Environmental Impact Report is necessary. The City understands the concerns of the comment, but notes that the City has developed specific mitigation measures over and above the standard Noise requirements for construction projects that occur within the City which are subject to the provisions of Section 7.15.025 of the Municipal Code. All applicable mitigation measures of City Council Policy Statement 600-11 have been imposed. Although the overall construction time period is anticipated to extend over an approximate 10-12 month time period, upon project completion noise impacts will return to the current levels as the overall operational characteristics of the project are basically the same as the existing facility. 6-10. The comment regards the potential of utilizing a portion of the project site for bioremediation of runoff. The grading plans for the building site and the public parking lot indicates the following regarding the approximately 23,900 square feet of paved areas: ^ All paved areas behind station security gates: ^ All paved areas will drain to a gutter system that consists of a surface traffic grate with a fossil filter insert consisting of 18" minimum of crushed rock wrapped with a filter fabric; ^ Any overflow will then drain into a 6° PVC perforated pipe over crushed rock in a trench that is a minimum of 18" wide and has a depth of 36" below pipe depth, all of which is wrapped with a fabric filter; and ^ Any remaining overflow will then drain through a rectangular drain box to the existing trapezoidal channel; along Seaf Beach Boulevard. ^ All public parking paved areas: ^ All paved areas will drain to a gutter system that consists of a surface traffic grate with a fossil filter insert consisting of 18" minimum of .. crushed rock wrapped with a filter fabric; City of Seal Beach Fire Station 48 Replacement Project 24 Mitigated Negative Declaration 08-3 Responses to Comments ATTACHMENT 1 "Minor Revisions to Mitigated Negative Declaration No. 08-3" City of Seal Beach Fire Station 48 Replacement Project 26 Mitigated Negative Declaration 08-3 Responses to Comments Minor Revision to Mitigated Negative Declaration No. 08-3 The City has made a minor revision to the Project description of Mitigated Negative Declaration 08-3 (the "MND"). As discussed in the MND, the project included the temporary relocation of fire station facilities to the City Maintenance Yard at 1776 Adolfo Lopez Drive. As revised, the location of the temporary station facilities may be at any of several sites within the City, including, but not limited to, the City Maintenance Yard. In no case will the temporary facilities be located more than 3 miles from 3131 Beverly Manor Road, Seal Beach. The revised Project description will improve pazamedic, medical aid, and fire suppression response times for the Fire Station 48 response area. Pursuant to Section 15073.5(c) (4) of the CEQA Guidelines, the above change in the Project description is an insignificant modification of the MND, which does not require recirculation and a new public review period. The change to the project description does not qualify as a "substantial revision" under Section 17073.5(b) of the CEQA Guidelines. No new, avoidable significant effect has been identified subsequent to the change in the project and no new mitigation measure or project revision is required to reduce any environmental effects to a level of insignificance. Battalion Chief JJ McMasters has reviewed the modified project description and determined that the response times of emergency vehicles will, as a result of the change, be the same if not better than they would be under the original Project description. Moreover, the possibility that emergency response vehicles may be located inside Leisure World will not have any significant noise impacts not already analyzed in the Mitigated Negative Declaration because it is akea.dy the policy of the Orange County Fire Authority to not employ sirens when inside the boundaries of Leisure World except when required for safety. Thus, as circulated, the MND fully analyzed the potential environmental impacts of the project as modified by this minor revision. Station 48 Replacement Project Prepared by: City of Seal Beach 211 Eighth Street Seal Beach, CA 90740 Contact: Lee Whittenberg, Director of Development Services (562) 431-2527, extension 1313 DECEMBER 8, 2008 Fire Station 48 Replacement Project MITIGATION MONITORING PROGRAM FOR THE FIRE STATION 48 REPLACEMENT PROJECT PROJECT DESCRIPTION The new fire station will replace a 40-year old facility that is in a gradual state of deterioration, and will encompass 12,987 square feet, approximately 7,900 square feet larger than the current Fire Station 48 facility. The proposed Fire Station 48 Replacement project consists of an approximately 12,987 square foot building designed to address current and future needs of the Orange County Fire Authority to provide appropriate levels of emergency response personnel and also provides a "training facility" that may be utilized by the City of Seal Beach for various training functions, including serving as a back-up Emergency Operations Center (EOC) if the main EOC facility at the Seal Beach Police Department is not operational due to an earthquake or other natural disaster event. The building is proposed to provide 3 apparatus bays, sleeping facilities for 10 fire personnel, and a 1,430 square foot "training room" with kitchen and restroom facilities that are independent of the main fire station facilities. The current facility provides 2 apparatus bays and sleeping facilities for 6 fire personnel. Mitigation Monitoring Program California's Public Resources Code §21081.6 requires that a lead or responsible agency adopt a mitigation monitoring program (MMP) when approving or carrying out a project where an environmental document-either an environmental impact report (EIR) or a mitigated negative declaration (MND)-has identified measures to reduce potential adverse environmental impacts to levels that are less than significant. The City of Seal Beach is the lead agency for the Fire Station 48 Replacement Project and is therefore responsible for implementing the MMP. The attached table identifies the mitigation program that the City of Seal Beach must implement for the proposed project. The mitigation program includes the following components: standard conditions (SC) and mitigation measures (MM). The table identifies the timing of implementation; the respective SC or MM required; and the City Department responsible for monitoring compliance. The numbering system corresponds with the numbering system used in the MND. The last column of the MMP table will be used by the Compliance Monitor to document implementation of the measure. The on-going documentation and monitoring of mitigation compliance will be completed by the City of Seal Beach. The completed MMP and supplemental documents will be kept on file at the City of Seal Beach Development Services Department. If the screening is done at another location, a separate monitor shall be required. ^ All mechanical excavation conducted in deposits that may contain human remains (i.e., all areas not completely within undisturbed soil profiles) shall be monitored by a Native American. This shall be done through the excavation of 1 x 1 m activities exploratory test units (ETUs) placed along transects extending radially from each identified burial or burial cluster. The spacing of the ETUs shall be determined upon consultation with the Project Archaeologist and the MLD. The radial transects shall be designed to test areas within 50 feet (15 m) from the edge of each burial or burial cluster. Excavation of these units shall be limited to areas containing intact cultural deposit (i.e., areas that have not been graded to the underlying undisturbed soil profiles) and shall be excavated until the undisturbed soil profiles are encountered, or to the excavation depth required for the approved grading plan. The soil from the ETUs along the radial transects shall be screened only if human remains are found in that unit. ^ Controlled grading shall be conducted within these 50-foot heightened investigation areas with a wheeled motor grader. The motor grader shall use an angled blade that excavates 1 to 2 inches at a pass, pushing the soil to the side to form a low windrow. Monitors shall follow about 20 feet behind the motor grader, examining the ground for evidence of burials. Burial Removal and Storage Consultation with the MLD shall occur regarding the treatment of discovered human burials. If the MLD determines it is appropriate to have discovered human remains pedestaled for removal, that activity shall be conducted in a method agreed to by the MLD. ^ After pedestaling or other agreed upon burial removal program is completed, the top of a burial shall be covered with paper towels to act as a cushion, and then a heavy ply plastic will be placed over the top to retain surface moisture. Duct tape shall be wrapped around the entire pedestal, securing the plastic bag and supporting the pedestal. Labels shall be placed on the plastic indicating the burial number and the direction of true north in relation to the individual burial. Sections of rebar shall be hammered across the bottom of the pedestal and parallel to the ground. When a number of parallel rebar sections have been placed this way, they shall be lifted simultaneously, cracking the pedestal loose from the ground. The pedestal shall then be pushed onto a thick plywood board and lifted onto a pallet. A forklift shall carry the pallet to a secure storage area or secure storage containers located on the subject property. Study of Burial Remains ^ If the burials are removed in pedestal and are incompletely exposed, osteological studies are necessarily limited to determination (if possible) of age, sex, position, orientation, and trauma or pathology. After consultation, and only upon written agreement by the MLD, additional studies that are destructive to the remains may be undertaken, including radiocarbon dating of bone or DNA studies. If the MLD determines that only non- _ destructive additional studies may be allowed, one shell may be removed from each burial and submitted for radiocarbon dating. The assumption here is that the shell would have been part of the fill for the burial pit, and therefore would provide a maximum age for the burial. ^ The MLD may indicate a willingness to consider some additional exposure and study of the skeletal material removed from the sites. Such study would not involve removal of the remains from the project area, but rather would be undertaken near the storage area. To the extent allowed by the MLD, the bones would be further exposed within the existing pedestals or other medium containing the human remains and additional measurements taken. Consultation with the MLD regarding the feasibility of these additional studies prior to reburial would occur. If this occurs, additional analysis shall be conducted. The analysis shall be designed to more completely address the research issues discussed in the approved "Research Design," and to provide additional mitigation of impacts to the sites in light of the new finds. Do they correspond to the full temporal range of activities site use, or only a limited timeframe? Although direct dating of the bones may not be possible due to the destructive nature of the radiocarbon technique, the MLD may approve the removal of a single shell from the interior of each burial for dating. Although this shall not provide a direct date of the burial, assuming the shell was part of the burial fill it should provide a maximum age (that is, the burial should not be older than the shell). In addition, an equivalent number of additional samples from non-burial contexts would also be taken for comparative purposes. These data would provide a more secure measure of the intensity of occupation during different periods. ^ Sediment Cores. Dating results obtained to date on the Hellman Ranch/John Laing Homes properties may suggest a possible link between the use of the sites within the project area and the productivity of the adjacent lagoon and estuary systems. To assess this link using independent environmental data on the subject property, two sediment cores will be taken from suitable locations of the property. Sediments in the cores shall be examined and described in the field by a geologist, and samples collected for dating and pollen analysis. These data shall then be used to help reconstruct the habitats present on the property during the periods the sites were occupied. Because these features are uncommon and represent very culture-specific religious practices, they are useful in reconstructing cultural areas during certain times in prehistory. Analysis of animal interments will include: (1) exposure to determine burial position; (2) photo documentation; (3) examination of skeleton for age/sex; traumatic injury, pathology, butchering, or other cultural modification; (4) radiocarbon dating; and (5) examination of grave dirt for evidence of grave goods or stomach contents. HYD-2 Prior to the issuance of the first grading or building permits, a comprehensive Water Quality Management Plan (WQMP) shall be prepared by a registered civil engineer or a registered professional hydrologist to protect water resources from impacts due to urban contaminants in surface water runoff. The WQMP shall be prepared in coordination with the Regional Water Quality Control Board, Orange County, and the City of Seal Beach to insure compliance with applicable National Pollutant Discharge Elimination System (NPDES) permit requirements.
