A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH DElrIING VARIANCE NO.
V-59-72 TO PERMIT A LATH TYPE PATIO COVER IN
REQUIRED SIDE YARD AND REAR OF R-1 DISTRICT II
PROPERTY, AND AN 8'9" HIGH FENCE. (BRANDAU)
WHEREAS, 1n the matter of Variance Application No. V-59-72, the Planning Commission
of the C1ty of Seal Beach does report as follows:
1. SubJect case initiated by Kenneth L. Brandau, 424 Corsair Way, Seal Beach.
2. SubJect property described as Lot 45, Tract 6345.
3. SubJect proposal is to allow a patio structure in required s1de yard, a
s1milar structure at the rear of the property and a fence to remain which
is 8 '9" high.
WHEREAS, the Planning Commiss1on f1ndings are as follows:
1. Structures were built W1thout permits or approval by the Architectural
Review Board.
2. Prov1Bions of the Precise Plan for the area allow fences a maximum height
of 8 feet.
3. The 6 foot s1de yard on the subJect property is a requ1red yard and must
rema1n open and unobstructed from the ground to the sky.
4. One wr1tten protest was received obJect1ng to any variance from the code
or Precise Plan.
5. No hardship seems to be demonstrated that would warrant a fence of 8'9" or
structures to encroach into requ1red yards.
NOW, THEREFORE, BE IT RESOLVED that the P1ann1ng Comm1BB1on of the City of Seal
Beach does hereby deny Var1ance V-59-72.
ADOPTED AND APPROVED th1s 20th day of December, 1972.
