RESOLUTION NO. 710
A RESOLUTION OF THE BLANNING COMMISSION OF THE CITY
OF SEAL BEACH REAFFIRMING ITS PREVIOUS ACTION IN
DENYING V-51-72 AND RECOMMENDING TO THE CITY COUNCICL,
DENIAL OF APPEAL APPLICATION NO. A-7-72. (PALMER)
WHEREAS, in the matter of Appeal Application No. A-7-72, the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject case initiated by John Palmer. 2232 Della Lane. Anaheim.
2. Subject property described as Lot 1, Block A. Surfside Colony
(AI Surfside)
3. Subject appeal was to denial of the Planning Commission of
Variance Application V-51-72 which proposed the contruction
of a single family residence in the R-l Zone with less than
required exterior side yards.
4. City Council held a public hearing on A-7-72 on November 27. 1972 and
referred the matter back to the Planning Commission with
findings in exhibit "A".
5.
Planning Commission considered the City Councils' findings on
December 6. 1972.
WHEREAS, the Planning Commission findings are as follows:
1. Each of the City Councils findings was considered in relation
to the total proposal.
2. The mitigating qualitites of each proposal was considered.
3. Tbe Planning Commission was of the opinion that a lot which was
3 inches narrower in one dimension than the normal 25 foot wide
lot was not sufficient hard hips to warrant a two foot
encroachment of the building into a required three foot side
yard. on the second and third floors.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby affirm its previous action and recommend to the City Council
denial of Appeal No. A-7-72 for the reason that there were no changes in the
conditions from there originally considered to warrant the encroachment
requested by the applicant.
ADOPTED AND APPROVED this 6th day of December, 1972.
