A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECO~mNDING TO THE CITY COUNCIL THE ADOPTION OF AN ALTERNATIVE TO GIVE LEGAL STATUS TO CERTAIN R-l DWELLINGS WHICH CURRENTLY EXCEED THE MAXI}D[M LOT COVERAGE PROVISIONS OF THE ZONING ORDINANCE. WHEREAS, in provisions of the Besch does report the matter of dwellings which exceed the maximum lot coverage zoning ordinance, the Planning Commission of the City of Seal as follows: 1. On August 14, 1972, the City Council referred the matter of certain over built homes to the Planning Commission for study and requested that action be under- taken to resolve the situation at the earliest opportunity. 2. Each of the 8 alternatives contained in Exhibit "A" was discussed and their various merits and detriments were considered during a series of Planning Commission meetings held during August, September, October and November, 1972. 3. After consideration of the 8 alternatives, numbers 1 and 7 were further discussed with a view toward choosing a fair and equitable solution to the lot coverage problem. WHEREAS, the Planning Commission findings are as follows: . 1. The Planning Commission is of the opinion that current lot coverage requirements contained within the zoning ordinance are desireable. 2. The Planning Commission is of the opinion that, since the homes were overbuilt by the developer, the individual homeowner should not have to be burdened with an illegal home. Therefore, the status of the homes should be changed from illegal to legal. NOW, TIIEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby recommend to the City Council that; 1. There should be no increase in the 40% lot coverage requirements. 2. Those Model 15 and Model 19 homes for which building permits have been issued, be given a time limit of 90 days for which to apply for a variance. 3. That the City Council waive the variance fee for those homes in College Park East so identified in number 2 above. ADOPTED AND APPROVED this 15th day of November, 1972. .
