A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING AND RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF AN AtIENDMENT TO THE ZONING APPENDIX OF THE CITY CODE REGARDING NON-CONFORMING STRUCTURES BY REASON OF LESS THAN THE REQUIRED SIZE OF PARKING SPACES. WHEREAS, in the matter of non-conforming structures by reason of parking space size, the Planning Commission of the City of Seal Beach does report as follows: 1. Res1dential structures were built under Ordinance 406 which required one parking space for each single family residential structure. 2. In 1963, Ordinance 628 was adopted which requires each single family residential structure to be provided with two parking spaces w1th a size of 10' x 20'/space. Multiple family units must have park1ng spaces of 9' x 20'. 3. The adoption of Ordinance 628 caused many residential structures to become non-conforming by reason of parking spaces of less than the required length and/or width. 4. Section 1910 of Zoning Ordinance prohibits structural alterations or addit10ns to these structures. WHEREAS, the Planning Commission findings are as follows: 1. Parking spaces of 9' x 19' interior dimensions, with a 24' turning . radius although less than the required size, are usable. 2. No special privilege would be granted by allowing additons or alterations to residential structures with the requisite number of spaces of 9' x 19' interior dimensions with a 24' turning radius. 3. The amendment shown 1n exibit "A" 1S proposed. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve and recommend to the City Council adoption of the amendment shown 1n exhibit "A". EXHIBIT "A" Section 1910, Article 19, General Prov1sions, Conditions and Except1ons, Non-conforming Buildings and Uses, of the Zoning Appendix of the City Code is amended by the addition of Section 1910.1 as follows: . Sec. 1910.1, The Effect of Non-conforming Parking Space Dimensions On Structural Alterations. The prohibition against the enlargement, structural altera- tion or expansion of a non-conforming bUilding contained in Section 1910 shall not apply to residential buildings which are non-conforming only be reason of a failure to comply with the provisions of this code as to the required dimen- sions of parking spaces or garages unless the proposed structural alteration or expansion creates one or more additional dwelling units or requires one or more additional parking spaces. The minimum size of an existing non-conforming parking space for purposes of this section shall be 9' x 19' interior dimensions with a minimum of a 24' turning radius. .
