RESOLUTION NO. 669
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH DENYING USE VARIANCES NO. UV-4-72, TO
PERMIT A 9 UNIT APARTMENT BUILDING IN THE C-l ZONE
WITH VARIANCES FOR: EXCESS LOT COVERAGE, LESS THAN
REQUIRED LOT AREA PER DWELLING UNIT AND NO EXTERIOR
SIDE YARD.
WHEREAS, in the matter of UV-4-72, the Planning Commission of the City of Seal Beach,
does report as follows:
1.
Subject case initiated by Emanuel Gyler, 3606 Parkview Drive, Lakewood.
2.
Subject property described as lots 5, 6 & 7, Block D, Tract 1. (vacant)

Subject proposal is to construct a 9 unit apartment building in the C-l
Zone with variances for: excess lot coverage, less than required lot
area per dwelling unit and no exterior side yard.

Mr. Dunn abstained from all discuss10n and voting on subject case.
WHEREAS, the Planning Commission findings are as follows:
1.
In recent years the Planning Commission has approved excess lot coverage
requests on R-3 properties only in the case of oddly shaped lots which
constitue hardship under Sec.2002 of Zoning Appendix.
The Planning Commission has approved developments with less than required
lot area per dwelling unit only in cases where less than half (.5) of unit
have been requested.

Although ambiguity exists with regard to the requirement for an exterior
side yard in the Seal Way area, the Planning Commission ruled that an
exterior side yard is needed.
4.
No hardship as defined under Sec.2002 of Zoning Code exists in subject property.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach
does hereby deny UV-4-72 for the reasons listed in "findings" 1-4.
ADOPTED AND APPROVED this 6th day of September, 1972.

of the Planning Commission of the City of Seal Beach which was held on Wednesday,
September 6, 1972, and carried by the following vote: ~
