. RESOLUTION NO. 662 .
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH DENYING ZONE CHANGE APPLICATION NO. C2-1-72
FOR A CHANGE OF ZONE ON A 36,000 SQUARE FOOT PARCEL OF
LAND FROM C-2-PP TO C-2.
WHEREAS, in the matter of C2-1-72, the Planning Commission of the City of Seal
Beach does report as follows:
1. Subject case initiated by Southwest Propert1es (Southrich Co.) P. O. Box
5387, Orange, CA.
2. Subject property described as a vacant 36,000 square foot parcel of land
located on the southwest side of Pacif1c Coast Highway, northwest of and
adjacent to 490 Pacific Coast Highway. (legal descript10n on file with
the Planning Department)
3. SubJect proposal is to change the zone from C-2-PP (General COIIDDercial-
Precise Plan) to C-2 (General Commercial).
WHEREAS, the Planning Commission findings are as follows:
1. All legal notices were posted as required by law.
2. The subject property was originally zone C-l (Service-Commercial) and at
the t1me of adoption of PR-1-66 for the development of Bridgeport, the
zone was changed to G-2-PP and a condition of the Prec1se Plan was the
designation of a dinner house restaurant on the parcel.
3. App11cant indicates that he has been unable to get a tennent for the
property with the restrictions on the uses permitted on the property
and requests a zone change to C-2 (General Commerc1al), in order to
allow greater latitude for development.
4. At the time of the application, McDonalds Co., indicated an interest in
acquir1ng the property for a Drive-In Restaurant.
5. Many property owners opposed the zone change based upon the poss1ble
location of a Drive-In Restaurant on the property.
6. Members of the Planning Commission ind1cated that if the request was den1ed
and after the appeal per10d term1nated, the staff would be directed to
prov1de background information of the subject property so the Commission
could determine 1f a more restrictive zone other than C-2-PP or C-2 would
be desireable for the property.
7. Planning Commission felt that the property could be developed under the
standards of the Precise Plan, as a dinner house restaurant.
NOW, THEREFORE, BE IT RESOLVED that the Planning Comm1ssion of the City of Seal
Beach does hereby deny zone change application No. CZ-1-72 because the Planning
Commission was of the opinion that a "dinner-house restaurant" called for in
the precise plan could be developed on the site.
