RESOLUTION NO. 654 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING VARIANCE V-29-72 FOR AN ALUMINUM AND FIBERGLASS STRUCTURE (POOL COVER) IN THE REQUIRED YARDS ON R-l PROPERTY WITH AN EXISTING NONCONFORMING BUILDING. WHEREAS, in the matter of Variance Application No. V-29-72, the Planniug Commission of the City of Seal Beach does report as follows: 1. Subject case initiated by Gualbero N. Vergara, 3670 Marigold St., Seal Beach. 2. Subject property described as Lot 31, Tract 6460, and is commonly known as 3670 Marigold St. 3. Subject proposal is to construct an aluminum and fiberglass pool cover in the required rear yard in the R-l zone on property with an existing nonconforming bulldiug . WHEREAS, the Planning Commission findings are as follows: 1. Existing house is nonconforming due to excessive lot coverage. 2. The proposed pool cover would constitute a structure and therefore must observe setbacks and lot coverage provisions. 3. No hardship is demonstrated as per Sec. 2002 (2) of the ZoniDg Code. 4. Approval of the request could establish an undesirable precedent for other types of pool covers and/or structures. NOW, THEREFORE, BE IT RESOLVED that the Planniug Commission of the City of Seal Beach does hereby deny Variance V-29-72.
