RESOLUTION NO. 645
A RDilOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING VARIANCE
V -22-72 TO PERMIT FIREPLACE FLUE AND TIMBER
PROJECTIONS INTO REQUIRED SIDEYARDS IN
SURFSIDE COLONY. (LAURA DELACY/RICHARD MOODY)
WHEREAS, in the matter of Variance Application No. V-22-72, teh Planning Commission
of the City of Seal Beach does report as follows:
1. Subject case initiated by Laura C. Delacy, A-9 Surfside Colony, Seal Beach,
with Richard Moody the authorized representative.
2. Subject property described as Lot 10, Block A, Fractional Section 24 in
Township 5 South, commonly known as AlO Surfs ide Colony.
3. Subject proposal is to permit a 12" projection of a fireplace flue into a
required side yard and a 6" projection of timbers into both required side yards.
WHEREAS, '&i1e Planning Commission findings are as follOll's:
1. The proposed fireplace flue is of metal construction and would project 12"
at a height of 12 feet.
2. The proposed timbers constituted "architectural feature" under the code
. definitions and would project 6" into both required side yards.
3. A grant of easement between Surfs ide Colony, Ltd. and Laura Delacy has been
canpleted but not recorded.
4. A letter from Surfs ide Colony, Lts. has been received approving the plans as
presented except for the fireplace flue and timbers projecting into yards.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby approve V-22-72 with the conditions that (1) interior dimensions
of garage be 18' x 20' minimum with parking open and unobstructed, (2) bearing
walls be kept out of required side yards, and (3) a copy of grant of easement
between Surfs ide COlony, Lts. and Laura C. Delacy be furnished to the City
following recordation.
ADOPTED AND APPROVED this 21st d~ of June, 1972.
I hereby certify that the foregoing resolution was duly adopted at a regular
meeting of the Planning Commission of the City of Seal Beach which was held on
Wednesd~, June 21, 1972, and carried by the following vote:
