RESOLUTION NO. 620
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH DENYING USE VARIANCE NO. UV-2-72
TO PERMIT THE OPERATION OF A STORE AND CAFE IN AN
R-3 ZONE. (ARTUKOVICH)
WHEREAS, in the matter of Use Variance Application No. UV-2-72, the Planning
Commission of the City of Seal Beach does report as follows:
1. Subject case was initiated by John Artukovich, 16011 Meadow Crest Road,
Sherman Oaks, California, through his authorized agent, Anthony Eggebrecht,
19861 Claremont Lane, Huntington Beach, California.
2. Subject property described as Parcel 28, Page 461, Book 178, Assessor's
Maps of Orange County, commonly known as C-17 Phillips St., Surfside.
3. Subject proposal is to permit the operat1on of a store and cafe in an
R-3 Zone with no on-site parking.
WHEREAS, the Planning Commission findings are as follows:
1. Subject property has been periodically operated as a commercial facility
prior to and following annexation of the Surfs ide area.
2. The store has been closed since September, 1971, and the nonconforming use
would be considered abandoned after three months in accordance with
Sec. 1901.1 of the Code.
3. The proposed use would require 16 on-site parking spaces and none are
provided.
4. The Board of Directors of Surfside Colony, Ltd. did not provide any
recommendation favoring or opposing the proposed commercial use.
5. A petition of approximately 150 signatures was received favoring the request.
Three persons spoke in favor of the request.
6. Nine persons, some of whom were members of the Board of Directors, spoke in
opposition to a commercial operation.
7. Applicant stated no signs would be oriented towards Pacific Coast Highway
and no coin-operated "pinball" machines would be installed at the premises.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal
Beach does hereby deny Use Variance No. UV-2-72 since it could establish an
undesirable precedent of allowing commercial uses in a res1dential zone.
