TO PERMIT THE CONSTRUCTION OF A CANTILEVER OF UPPER STORIES INTO A REAR YARD SETBACK WlIICH WOULD INCREASE LOT COVERAGE FROM 78% TO 82%. WHEREAS. ~n the matter of V-9-72, the Planning Commission of the City of Seal Beach does report as follows: 1. Subject case initiated by Emanuel Gyler. 3606 Bayview Drive, Lakewood. CA. 2. Subject property is described as Lot 15 & 16, Block D. Tract 1009, commonly known as 1005 & 1007 Seal Way, Seal Beach. 3. Subject proposal is to permit construction of a four and one-half foot cantilever of upper stories into a rear yard setback; which would increase lot coverage from 78% to 82%. WlIEREAS. the Planning Commission findings are as follows: 1. The maximum allowable lot coverage in R-3 zone, District I, is 75%. . 2. By appeal on Variance Application No. V-21-7l, the Planning Commission approved four variance applications; less than required parking. less than required side yard setback, less than required turning radius, and more than allowable lot coverage (78%). The only variance application condition denied was rear yard setback, which was to be msintained at nine feet. 3. The proposed four and one-half foot cantilever of upper stories into the rear yard would constitute relief from the conditions of Appeal Application A-6-7l approval. 4. The proposed four and one-half foot cantilever would increase lot coverage from 78% to 82%. NOW. THI>REFORE. BE IT RESOLVED chat the Planning Commiss~on of che Cicy of Seal Beach does hereby deny Variance Application No. V-9-72. ADOPTED AND APPROVED this 15th day of March, I hereby certify that the foregoing resolution was dilly adopted at a regular meeting of the Planning Commission of the City of Seal Beach which was held on Wednesday, March 15, 1972. and carried by the follOWing vote: .
