RESOLUTION NO. 611 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING ABD RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO ARTICLE 18 OF THE ZOBING APPENDIX OF THE SEAL BEACH CITY CODE RELATING TO DISTRICT III, SURFSIDE COLONY. WHEREAS, in the matter ot provisions related to Article 18, District III. Sur:fside ColoD;y. ot the Zoning Appendix to the Seal Beach Cit;y Code. the Planning COIIIIIIission o:f the Cit;y ot Seal Beach does report as tollows: 1. It is proposed that provisions o:f Paragraphs B and E. Sec. 1801.1. Article 18, o:f the Zoning Appendix be &mended with moditications to the minimum side;yard requirements, provisions tor side;yard encroachments, and review and approval ot development plans b;y Burtside Colony in accordance with the proposed ordinance attached as Exhibit A. 2. A public hearing was held on March 15, 1912. after proper legal notice had been posted at least ten dqs prior to said hearing. WHEREAS, the Planning Commiss~on :findings are as f'ollows: 1. By restrict~ng the location ot stairw~s and walkw~. one side ;yard would be kept open between buildings to provide emergenc;y access to the rear o:f the properties. 2. Most reS1dences on Block A are built on piling because ot the threat ot high surf'. As a result, the tirst tloor living quarters are several teet above surf'ace grade and stairwqs and/or elevated walkw~s are needed to permit access to the :first tloor. 3. Provisions to permit cornices or eaves to proJect into the side;yards COllld improve the appearance of new construction. 4. Sur:fside Co10D;y. Ltd. admin~sters several special districts including Surtside Communit;y Service District which maintains private streets and street lighting. Developers must enter into agreements with Burts ide Colony. Ltd. prior to construction. 5. The Bur:fside Colony's Board o:f Directors has requested the City's cooperation in reterring construction plans f'or proposed developments within the Co10D;y to the said Board tor approval. 6. No obJect~oDS, written or oral, were received. NOW. THEREFORE. BE IT RESOLVED that the Planning Commission ot the Cit;y ot Seal Beach does hereby approve and recommend to the Ci t;y Council the adoption o:f smendments to Article 18 ot the Zoning Appendix ot the Seal Beach Cit;y Code as set torth in the proposed ordinance attached as Exhibit A. . . . . . .
