HomeMy WebLinkAboutPC Res 768 - 1973-08-15 . . . ~. - - RESOLUTION NO. 768 A RESOLUTION OF THE PLANNING CO~IMISSION OF THE CITY OF SEAL BEACH APPROVING AND RECOMMENDING THAT THE CITY COUNCIL MIEND ARTICLE 18, SECTION 1819, OF TIlE ZONING APPENDIX TO THE CITY CODE. WHEREAS, in the matter of amending Section 1819, the Planning Commission of the City of Seal Beach does report as follows: 1. Section 1819 of Article 18 of the Zoning Appendix to the City Code regarding side yards abutting front or rear entrances of dwellings reads as follows: "Sec. 1819. Side yards abutting front or rear entrances of dwelling. Where dwellings are arranged so that tlleir front or rear entrances abut on a side yard, the required side yard abutting the front entrances shall be increased two feet for each dwelling unit having a front entrance opening into or reached via the side yard, and the required side yard abutting the rear entrances shall be increased one foot for each dwelling unit opening into or reached via the side yard; provided, such increase need not exceed five feet." 2. Ambiguity exists in the interpretation of this provisions. 3. In the interest of clarity, an amendment is proposed which will more clearly express the meaning of the provision. WlIEREAS, the Planning Commission findings are as follows: 1. The following amendment is proposed in order to clarify the meaning of Section 1819 of the Zoning Appendix of the City Code. "Sec. 1819. Side yards abutting front entrances of dtlelliDRs. Where dwellings are arranged so that their front entrances abut on a side yard and the required side yard is less than five (5) feet, the setback at the main entrance shall be increased to five (5) feet at the main entrance abutting the side yard except where other provisions of this ordinance requires a side yard setback in excess of five feet. A. In the case of single leaf doors and stairways said five (5) ~oo~ setback shall extend two (2) feet on both sides of the single leaf door and stairway entrance or landing. B. In the case of double leaf doors, said five (5) foot setback shall extend one (1) foot on both sides of the double leaf doors."
