HomeMy WebLinkAboutPC Res 766 - 1973-08-01 . . . - - RESOLUTION NO. 766 A RESOLUTION OF TIlE PLANNING COMMISSION OF THE CITY OF SEAL BEACH CLARIFYING SECTION 1819 OF THE ZONING APPENDIX TO THE CITY CODE. WlIEREAS, in the matter of Section 1819, the Planning Commission of the City of Seal Beach does report as follows: 1. A request was received for an interpretation of Section 1819, Zoning Appendix to the City Code, regarding sideyards. 2. Section 1819 reads as follows: Section 1819. "Sideyards abutting front or rear entrances of dwelling. Where dwellings are arranged so that their front or rear entrances abut on a sideyard, the required side yard abutting the front entrances shall be increased two feet for each dwelling unit baving a front entrance opening into or reached via the sideyard, and the required sideyard abutting the rear entrances shall be increased one foot for each dwelling unit opening into or reached via the side yard; provided, such increase need not exceed five feet." 3. Ambiguity exists over where the setback should be increased and to what the maximum side yard setback should be in the case of two or three entrances abutting one side yard. WHEREAS, the Planning COIIIIIIission findings are as follows: 1. The policy as previously interpreted by the Planning Commission and Planning Department is that the increase in setback should come only at the doorway and the maximum setback should be five (5) feet at the doorway in the case where the required setback is normally less than five feet. 2. Many structures have been built in the Coastal District based upon the above policy and the spirit and intent of Section 1819 seems to be met by this interpretation. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby interpret Section 1819 as follows: Sec. 1819. Side yards abuttinR front or rear entrances of dwelling. Where dwellings are arranged so that their front or rear entrances abut on a side yard, the required side yard abutting the front entrances shall be increased two feet at each separate entrance of each dwelling unit having a front entrance opening into or reached via the side yard, and the required side yard abutting the rear entrances shall be increased one foot at each separate entrance of each dwelling unit opening into or reached via the side yard; provided, such increase need not exceed five feet at said entrance except when other provisions of this ordinance would so require. . . . '. - - Resolution No. 766 - 2 ADOPTED AND APPROVED this 1st day of August, 1973.
