SUBJECT: MEMORANDUM OF AGREEMENT BETWEEN COUNTY
OF ORANGE AND CITY OF SEAL BEACH
REGIUESTING REIMBURSEMENT FOR CITY
SERVICES TO THE 2008 FREEWAY COMPLEX
WILDFIRES.
SUMMARY OF RE(~UEST:
Staff requests the City Council to receive and file this signed Memorandum of
Agreement (MOA) between the County of Orange and the City of Seal Beach
wherein the County is requesting reimbursement from the State of California for
all fire related law enforcement services rendered during the 2008 Freeway
Complex Fire.
BACKGROUND:
A wildfire of historic proportions struck portions of Riverside, San Bernardino, and
Orange Counties in November of 2008. The fire became known as the Freeway
Complex Fire and burned a significant number of homes and property in the
cities of Yorba Linda and Anaheim.
The Orange County Emergency Operating Area (OA) extended a request for law
enforcement mutual aid to help control neighborhood perimeters, traffic control,
and command post support.
The City of Seal Beach Police Department responded pursuant the request with
its Community Emergency Response Team (CERT) volunteer personnel and
truck and trailer rig. The unit was supervised by the City's Emergency
Preparedness Coordinator from Saturday, November 15 to Friday, November 21,
2008. He accrued seventy hours of overtime in this period.
The County of Orange Operational Area is petitioning the State of California, on
behalf of all the Orange County cities who provided mutual aid, for

reimbursement of their personnel and equipment expenses incurred during the
Freeway Complex fire emergency. The instrument used for the request is the
Memorandum of Agreement attached.
An urgent deadline for signature of the MOA fell between the December 2008
and January 2009 City Council Meetings causing me to request the City
Manager's signature prior to City Council review.
This report commemorates and supports his action on behalf of the City and City
Council.
FINANCIAL IMPACT:
70 hours of overtime = $3996. Reimbursed overtime may be returned to the
City's salary and overtime budget accounts.
RECOMMENDATION:
Staff recommends City Council receive and file this report, leading to potential
recovery of expended funds.

MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SEAL BEACH
AND THE COUNTY OF ORANGE PERTAINING TO ASSISTANCE UNDER
THE LAW ENFORCEMENT MUTUAL AID PLAN
WHEREAS, on November 15'", 16s' and 17th, 2008 extreme weather conditions
consisting of strong winds and low humidity aided several fires that swept through the
region; and
WHEREAS, these fires consisted of the Triangle Complex Fire and Freeway Complex
Fires; and
WHEREAS, collectively these will be referred to as "Freeway Complex Fires;" and
WHEREAS, on November 18, 2008 a Presidential Declaration of Emergency (FEMA-
1810-DR-CA) was issued; and
WHEREAS, the Law Enforcement Mutual Aid Plan is issued and revised under the
authority of Sections 8550, 8569, 8615 through 8619, and 8668 of the California
Government Code, the California Emergency Plan, and the Master Mutuat Aid
Agreement; and
WHEREAS, the Law Enforcement Mutual Aid Plan delineates the current state policy
concerning law enforcement mutual aid; and
WHEREAS, the Law Enforcement Mutual Aid Plan describes the standazd procedures
used to acquire law enforcement mutual aid resources and the method to ensure
coordination of law enforcement mutual aid planning and readiness; and
WHEREAS, the county sheriff is the Operational Area Law Enforcement and Mutual
Aid Coordinator; and
WHEREAS, Law Enforcement Mutual Aid Plan provides, in pertinent part, "When an
emergency develops or appeazs to be developing which cannot be resolved by a law
enforcement agency within an Operational Area, it is the responsibility of the Operational
Area Mutual Aid Coordinator to provide assistance and coordination to control the
problem;" and
WHEREAS, the Law Enforcement Mutual Aid Plan provides, in pertinent part, "A
request for law enforcement mutual aid requires the approval of the chief law
enforcement officer of the requesting jurisdiction;" and
WHEREAS, the Sheriffof Orange County requested the mutual aid assistance of Seal
Beach Police Department, pursuant to the Law Enforcement Mutual Aid Plan to support
law enforcement services in connection with the Freeway Complex Fires; and
WHEREAS, THE Seal Beach Police Department provided mutual aid assistance
consisting of law enforcement personnel, equipment, and materials from November 16
through November 21, 2008 to assist with law enforcement services in connection with
the Freeway Complex Fires; and
WHEREAS, the City Of Seal Beach agrees to document all of its mutual aid assistance
costs related to the Freeway Complex Fires as attachments to this MOA and submit to the
County of Orange as soon as practicable; and
NOW, THEREFORE, IT IS HEREBY AGREED by and between the County of
Orange and the City of Seal Beach that the County of Orange shall reimburse all
reasonable costs associated with Seal Beach Police Department's law enforcement
mutual aid assistance during the Freeway Complex Fires as reimbursed through the Fire
Management Assistance Grant (FMAG #2792).
