ENHANCEMENT AND MITIGATION (EEM) PROGRAM
GRANT FUNDS TO THE STATE RESOURCES
AGENCY
SUMMARY OF REQUEST:
The City Council is asked to approve Resolution No. 5830 authorizing staff to
submit a grant application to the Environmental Enhancement and Mitigation
(EEM) Grant Program under the State Resources Agency (SRA).
BACKGROUND:
At the January 14, 2008 City Council meeting, Council reviewed and filed
landscaped medians plans on Seal Beach Boulevard from Bolsa Avenue to
Pacific Coast Highway. The plans will also improve landscaping on the existing
medians along Lampson Avenue.
The SRA is currently soliciting agencies to the EEM Program, which allocates up
to $10 million each year in grant funds to mitigate the environmental impacts of
highway landscape and urban forestry, resource lands and roadside recreation.
One of the requirements to submit a grant application to SRA for funding under
the EEM Program is to formally adopt a resolution approving the subject
application.
This application was submitted by the application deadline of December 22, 2008
and, if the resolution is approved, staff will submit it to the SRA to complete the
grant application package. Attached, please find a copy of the grant application
form. The entire grant application is available for viewing in the office of the
Director of Public Works.

FINANCIAL IMPACT:
No fiscal impacts at this time. The total construction cost of the project is
$1,000,000. The City is requesting the maximum amount of $350,000. If
successful the remaining short fall of $650,000 will be requested at a latter time
through a budget amendment. If the City share is not available when needed, the
City can decline the grant award.
RECOMMENDATION:
It is recommended that the City Council approve Resolution No. 5830 authorizing
staff to submit an application for grant funds to the Environmental Enhancement
and Mitigation Program under the California Resources Agency.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH APPROVING THE APPLICATION FOR GRANT FUNDS
FOR THE ENVIRONMENTAL ENHANCEMENT AND
MITIGATION PROGRAM UNDER THE SECTION 164.56 OF THE
STREETS AND HIGHWAYS CODE
WHEREAS, the Legislature of the State of California has enacted AB 471
(Chapter 106 of the Statutes of 1989), which is intended to provide $10 million
annually for a period of 10 years for grant funds to local, state and federal
agencies and nonprofit entities for projects to enhance and mitigate the
environmental impacts of modified or new public transportation facilities; and
WHEREAS, the Resources Agency has established the procedures and critena
for reviewing grant proposals and is required to submit to the Califomia
Transportation Commission a list of recommended projects from which the grant
recipients will be selected; and
WHEREAS, said procedures and criteria established by the Resources Agency
require a resolution certifying the approval of application by the applicants
governing body before submission of said application to the State; and
WHEREAS, the application contains assurances that the applicant, must comply
with; and
WHEREAS, the applicant, if selected, will enter into an agreement with the State
of California to carry out the environmental enhancement and mitigation project;
THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY RESOLVES AS
FOLLOWS:
SECTION 1. Approves the filing of an applicatan for the Environmental
Enhancement and Mitigation Program for grant assistance.
SECTION 2. Certfies that said applicant will make adequate provisions for
operation and maintenance of the project.
SECTION 3. Appoints City Manager as agent of the Seal Beach City Council to
conduct all negotiations, execute and submit all documents, including, but not
limited to applications, agreements, amendments, payment requests and so on,
which may be necessary for the completion of the aforementioned project.
PASSED, APPROVED AND ADOPTED by the City Council of Seal Beach, at a
meeting hereof held on the 12th day of January , 2009 by the following vote:

Seal Beach Boulevard and Lampson Avenue Median Improvements ~ 2008
1.0 EEMP PROJECT SUMMARY
The City of Seal Beach plans to construct landscaped medians on Seal Beach Boulevard
from Bolsa Avenue to Pacific Coast Highway. The city will also improve landscaping on
the existing medians along Lampson Avenue. See below for detailed scope of work. Both
streets are located within the City of Seal Beach. The project will improve the air quality
in Seal Beach, because of the trees and shrubs that will be planted in the landscaped
medians. Trees will deliver air quality benefits by the cooling effect of their shade and by
removing certain pollutants. Leaves have a surface area that can allow for removal
(deposition) of the ozone's, nitrogen dioxide, and to a lesser extent particulate matter.
The medians will reduce traffic conflicts and channelize motorist to minimize collisions.
The city has explored other alternatives sites throughout Seal Beach and these proposed
sites are best suitable for landscaped medians improvements. The reasoning behind this is
that these corridors are the primazy linkage to the Pacific Coast Highway and the I-405
Freeway, which are heavily affected by traffic congestion and air pollution. The project
will help mitigate and eliminate vehicle emissions and provide beautification to the City.
Detailed Scope of Work
Seal Beach Boulevard from Bolsa Avenaie Pacific Coast Highway
Construct approximately 17001ineal feet of new landscape medians with width vazying
from 14 feet wide to 4 feet wide. Also install decorative stamp concrete and 33 new trees.
Lampson Ave from 1000 feet west of Basswood Street to East City Limits
Install curb medians at various locations to close existing gaps in medians, install new
irrigation system, decorative stamp concrete and insta1192 new trees.
2.0 Agency Elisibility
We have attached a sample resolution that is scheduled on the January 12, 2009 Ctty
Council Meeting to adopt.
Also attached is the Januazy 14, 2008 City Council approved agenda item to receive and
file the complete construction bid documents for this project application.

C. ASSURANCES
Applicant possesses legal authority to apply for the grant and to finance, acquire,
and construct the proposed project; and by formal action (i.e., a resolution) the
applicant's governing body authorized the filing of the application, including all
understandings and assurances contained therein, and authorized the person
identified as the official representative of the applicant to actin connection with
the application and to provide such additional information as may be required.
Applicant will manage and maintain into the future any property acquired,
developed, rehabilitated, or restored with grant funds provided through this
program. For property acquisition or conservation easement, applicant will
accept, sign, notarize, and record an Agreement Declaring Restrictive Covenant
(ADRC) developed by the California Department of Transportation. With the
granting agency's prior approval, the applicant or its successors in interest may
transfer the management and maintenance responsibilities in the property. If the
property is not managed and maintained for the purposes stated in the
Agreement, the state shall be reimbursed an amount at feast equal to the amount
of the grant award or, for real property, the pro rata fair market value of the
property, including improvements, at the time of sale, whichever is higher.
Applicant will give the state's authorized representative access to and the right to
examine all records, books, papers, or documents related to the grant.
Applicant will cause work on the project to be commenced within a reasonable
time after receipt of notification from the state that funds have been approved
and that the project will be carried to completion with reasonable diligence. If
applicant cannot submit its first invoice for reimbursement to Caltrans by one
year from the date of the execution of the applicant-State agreement, applicant
will submit a statement of project progress appropriate to the project that
provides real assurances that the project will be completed prior to April 30,
2011, including but not limited to: project advertisement or firm advertisement
schedule, entry into escrow for acquisitions, date project plans will be completed,
anticipated date of receipt of other needed funds from specified entity, etc.
Applicant will comply where applicable with provisions of the California
Environmental Quality Act and the California Relocation Assistance Act and any
other state, and/or local laws, rules and/or regulations.
