HomeMy WebLinkAboutPC Res 06-24 - 2006-06-21 RESOLUTION NUMBER 06-24 ORIGINA A RESOLUTION OF THE PLANNING COMMISSION OF l THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 06-6, APPROVING A 6 FEET IN HEIGHT WATERFALUFIRE PIT STRUCTURE IN THE SIDE YARD SETBACK AREA AT 921 BLUE HERON, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Secllon I On May 18, 2006, RIchard Loghry, Emerald Pools ("The Applicant") filed an applicatIon for Mmor Plan RevIew 06-6 WIth the Department of Development ServIces Through MPR 06-6, the applicant sought to construct a 6 feet hIgh waterfall/fire pIt structure m the S feet slde setback area at 921 Blue Heron, Seal Bedeh SectIon 2 Pursuant to 14 Calif Code of Regs ~ IS02S(a) and & II B of the CIty'S Local CEQA GUidelines, staff has determIned as follows The applicatIon for Mmor Plan ReVIew 06-6 IS categorIcally exempt from review pursuant to the CalifornIa EnVIronmental QualIty Act pursuant to 14 CalIf Code of Regs & IS303 NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES (a) smgle-famIly reSIdences not m conJunctIon WIth the bUlldmg of two or more such Ul1Its In urballlzed meas, up to three smgle-famlly reSIdences may be constructed or converted under thIS exemptIon ~ IS06I(b)(3), because It can be seen WIth eertamty that there IS no pOSSIbIlity that the approval may have a SIgnIficant effect on the envIronment SectIon 3 A duly notIced hearIng was held before the PlaI1I1Ing CommISSIon on June 21, 2006 to conSIder the applicatIon for Mmor Plan ReVIew 06-6 SectIon 4 The record of the heanng on June 21, 2006 mdICates the followmg (a) On May 18, 2006, RIChard Loghry, Emerald Pools ("The Applicant") filed an applicatIOn for Mmor Pldn ReV1ew 06-6 WIth the Department of Development Services (b) SpeCIfically, the request IS to construct a 6 feet hIgh waterfall/fire-pIt structure m the S feet SIde setback area (c) The subJect property IS deSCrIbed as 199-201-49 alld IS located In the Hellmall Ranch SpeCIfic Plall (SPR) zone wlthm the neIghborhood generally referred to as "Heron Pomt" (d) The sunoundmg IdI1d uses and zomng are as follows t of3 MlIlor Plan RevIew 06-6, 921 Blue Hewn Plamllng Comm,s'lOn ResolullOll 06-24 June 21, 2006 NORTH SOUTH EAST WEST Hellman Ranch Wetlands m the SpecIfic Plan (SPR) zone Smgle family residences m the SpecIfic Plan (SPR) zone Smgle family resIdences m the SpecIfic Plan (SPR) zone Hellman Ranch Wetlands m the SpecIfic Plan (SPR) zone (e) The City receIVed no comments, WrItten or other, respondmg to the notIces of the hearmg on MPR 06-6 SectIon 5 Based upon the facts eontamed m the record, meludmg those stated m ~ 4 of this resolutIon, and pursUallt to ~ 28-401 of the CIty's Code, the Planmng CommIssIOn hereby finds as follows (a) Mmor Plan RevIew 06-6, as condItIoned, IS consistent with the prOVISIons of the Land Use Element of the City'S General Plan, whIch provIdes a "ResIdentIal Low DensIty" desIgnatIon for the subJect property and permIts the proposed development, subJect to approval of a Mmor Plan RevIew The use IS also consIstent wIth the remammg elements of the CIty'S General Plall as the poliCIes of those elements are consIstent WIth, alld reflected m, the Land Use Element Aeeordmgly, the proposed use IS consIstent WIth the General Plall (b) The proposed development, as condItIOned, complies WIth all development stalldards of the SpecIfic Plan (SPR) zone (c) The waterfall-fire pIt structure, as eondllloned, IS approprIate to the surroundmg neIghborhood as the structure IS all adequate dIstance from adJacent resIdences SectIOn 6 Based upon the foregomg, the Plalll1lng CommIssIon hereby approves Mmor Plan RevIew 06-6, subJect to the followmg condItIons I Mmor Plan RevIew 06-6 IS approved for a 6 feet hIgh waterfall/fire pIt structure located at 921 Blue Heron, Seal Beach, to be located flush to the eXIstmg 6-feet hIgh block wall fence on the SIde property Ime, where the Code reqUires a 5 feet setback 2 All constructIon shall be m substantIal eompllallee with the plalls approved through Mmor Plan ReView 06-6 3 BUlldmg permIts shall be obtmned for the approved structures 4 Fountam shall be turned off between 10 00 p m and 700 am 5 ThiS Mmor Plan ReVIew shaH not become effectIve for any purpose unless all "Acecptanee of CondItIons" form has been SIgned by the applicant m the presence of the DIrector of Development SerYIees, or notarIzed alld returned to the PlannIng Department, and untIl the ten (10) day appeal perIod has elapsed 20f3 MIIIOI Plan RevIew 06-6, 921 Blue lIelOn Planmng Comn....101l Re.olullO/I 06-24 June 21, 2006 PASSED, APPROVED AND ADOPTED by the PlaI1l1mg CommIssIOn of the CIty of Seal Beach at a meetmg thereof held on the 21st day of June 2006 by the folIowmg vote A YES CommIssIoners Deaton, Ladner, O'Malley, and Roberts, NOES CommIssIoners None ABSENT CommIssIoners None d./~Ar O~I?A-~-;; / ElIery Deaton Actmg ChaIrperson, Plannmg CommiSSIOn ~~ Secretary, PldI1mng CommISSIon **** 30f3
