I Seal Beach, California May 11, 1998 By direction of the City Council at their April 27th meeting, the May 11, 1998 meeting is hereby canceled and adjourned to Tuesday, May 19th at 7:00 p.m. Ci of Seal Beach, California May 19, 1998 I The City Council of the City of Seal Beach met in regular adjourned session at 7:00 p.m. with Mayor Hastings calling the meeting to order with the Salute to the Flag. ROLL CALL Present: Mayor Hastings Councilmembers Brown, Campbell, Forsythe, Fulton Absent: None Also present: Mr. Till, City Manager Mr. Barrow, City Attorney Mr. Steele, Assistant City Attorney Chief Sellers, Police Department Mr. Badum, Director of Public Worksl City Engineer Ms. Beard, Director of Recreation and Parks Mrs. Yeo, City Clerk I APPROVAL OF AGENDA Mayor Hastings requested to comment on the recent Duck-A-Thon as a part of the Presentation category of the agenda. Brown moved, second by Campbell, to approve the request. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried Fulton moved, second by Campbell, to approve the order of the agenda as amended. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried 5-19-98 PRESENTATIONS/RECOGNITIONS SENIOR VOLUNTEER PROGRAM - 2nd ANNIVERSARY Mayor Hastings commended the accomplishments of the Senior Volunteers during the past two years, and recognized Seal Beach resident, Jack Haley, as being directly responsible for this Program. Mayor Hastings reported the 1998 volunteer I hours through April is one thousand eight hundred fifty-two, the total hours for the two years, through April, is forty- three thousand, seven hundred seventy-nine, the Sub Station and the Volunteer Program more than worthy of praise. RESOLUTIONS NUMBERED 4622 thru 4626 - GIRL SCOUT SILVER AWARD RECIPIENTS - MUNJOY / OLSSON / LONG-LERNO / BRAUN / EPPS Resolutions Numbered 4622, 4623, 4624, 4625, and 4626 respectively were presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH HONORING AND COMMENDING DE SARI MUNJOY FOR ACHIEVING THE GIRL SCOUT SILVER AWARD" ; "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH HONORING AND COMMENDING KARA OLSSON FOR ACHIEVING THE GIRL SCOUT SILVER AWARD"; "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH HONORING AND COMMENDING JULIA LONG-LERNO FOR ACHIEVING THE GIRL SCOUT SILVER AWARD"; "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH HONORING AND COMMENDING ASHLEY BRAUN FOR ACHIEVING THE GIRL SCOUT SILVER AWARD"; and "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH HONORING AND COMMENDING CHARNI EPPS FOR ACHIEVING THE GIRL SCOUT SILVER AWARD." I Mayor Hastings announced that the Resolutions being considered for adoption at this meeting will be formally presented to the recipients at their upcoming Silver Award ceremony. By unanimous consent, full reading of Resolutions Numbered 4622 through 4626 was waived. Campbell moved, second by Fulton, to adopt Resolutions Number 4622 through 4626 as presented. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried DUCK-A-THON Mayor Hastings reported that the City of Seal Beach received and invitation from the City of Huntington Beach to participate in the sixth annual Duck-A-Thon, a charitable event supported by Huntington Beach. She noted that a Mayor's race was added this year, Laurann Cook, Fountain Valley, was first, Shirley Detloff, Huntington Beach, was second, stating in jest, both won by questionable methods, however Seal Beach won third place with honor and integrity. I ORAL COMMUNICATIONS Mayor Hastings declared Oral Communications open. Ms. Audrey Kime, College Park East, read a statement directed to the City Council expressing her objections to and criticisms of the lack of support afforded Councilmember Campbell for her request to cablecast live the meetings of the Environmental Quality Control Board consideration of the Bixby Draft Environmental Impact Report, to which she noted that 5-19-98 I fortunately the Cable Foundation saw fit to televise those meetings live on its own, which were conducted in good form and format. Mr. John Unrath, College Park East, stated that when the new cable franchise was passed there was a promise of new improved cable, improved cable does not mean losing the cable in late evening hours during special programs, losing channels which requires a call to the cable company at any hour, having a converter box that will not work with the universal remote control, adding new channels supposedly at no cost and then finding out there is a an increase in the rates to compensate therefore. He said the only thing that keeps him with cable now is to see what happens with the new upgrade that will supposedly be ready in June. Mr. Blake Hastings, Seal Beach, presented an armful of flowers to his mother, Marilyn, expressed his pride in her accomplishments during her eight years on the City Council, and conveyed his personal appreciation for Seal Beach and the wonderful people. Ms. Carla Watson, Seal Beach, thanked this City Council for their congeniality, their class, ability to get along, leadership, for working harmoniously together to make the City better. On behalf of herself, Jane MCCloud, Sally Hirsch, Wendy Rothman, and others, expressed appreciation to Councilman Fulton for his dignity, wise counsel, and activities on behalf of Save Our Pool, thanked Mayor Hastings for her dignity also, for reaching out to people who may not have been supportive, bringing them into the fold, allowing them to do good things for Seal Beach, a sign of true leadership, commended Councilmember Forsythe for being the heartbeat of the community for eight years, helping the City function, solving problems, bringing dignity to the position, for which they all expressed pride in her accomplishments, in addition, for not abandoning her position. Ms. Fran Johnson, Seal Beach, announced the third annual Wiener Dog Race at the Los Alamitos Race Track on May 30th, tickets available for $5, prepaid sales to benefit the Animal Care Center. She also thanked the Council for their interest in the Care Center. Mr. Frank Laszlo, College Park East, congratulated Mayor Hastings and Councilmember Forsythe upon concluding their terms of eight years, stating there are few people that understand the amount of work and study required of a member of the City Council, and conveyed appreciation on behalf of himself and others for their service to the community. Mayor Hastings noted the several City staff members present in the audience, recognized each, and commended them for being a wonderful team. There being no further comments, Mayor Hastings declared Oral Communications closed. I I WAIVER OF FULL READING Brown moved, second by Hastings, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried RESOLUTION NUMBER 4621 - DECLARING RESULTS OF ELECTION Resolution Number 4621 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 12th DAY OF MAY, 1998, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED BY LAW." By unanimous consent, full 5-19-98 reading of Resolution Number 4621 was waived. moved, second by Forsythe, to adopt Resolution presented. Campbell Number 4621 as AYES: NOES: RETIRING COUNCIL RECOGNITIONS I Councilman Brown presented a glass engraving to Councilman Fulton in recognition of his services to the City as a member of the Council. Councilman Fulton extended appreciation to the Council, staff, voters of District Five, and citizens of Seal Beach. Councilman Brown likened Councilmember Forsythe to his daughter, a bright person who does all of her homework, speaks with such conviction that you dare not disagree, and to Gwen expressed pleasure at having the opportunity to work with her on the City Council. Councilman Brown presented Councilmember Forsythe with an engraved glass bowl in appreciation and memory of her terms on the City Council from 1990 to 1998, the bowl filled with a flower arrangement. Councilmember Forsythe offered that the conclusion of her Council duties had been looked to with eagerness until the comments made by her friends. She stated that the people who work for the City of Seal Beach do not just work with their minds, they work with their hearts, and they need to be appreciated for what they do every day, special people who work very hard, she thanked her friends and supporters for their encouragement, specifically during times when resignation was being considered, and a special thanks to her husband and family, her greatest supporters and source of strength. To Mayor Hastings, Councilman Brown I distinguished her as being a mother to all in the City, a little bit Jewish, a little bit Indian, something for all for all seasons, and a special friend. He presented Mayor Hastings with the engraved glass bowl as well in appreciation and memory of her City Council terms from 1990 to 1998, also, presented a wooden gavel plaque commemorating her past year as Mayor of the City. Mayor Hastings accepted with appreciation, stating her message is shalom rather than goodby, that a message of peace, an attitude and feeling of the City Council. The Mayor too expressed appreciation of the City staff, in her case particularly the Public Works Department who care for the public beach. Mayor Hastings made personal presentations of appreciation of red roses to Pat O'Connor, City Clerk's office, pink roses to Jackie Guidry and yellow roses to Ginger Bennington, City Manager's office, white roses to Joanne Yeo, City Clerk, extended special appreciation to her fellow Councilmembers, the City Manager, the City Attorney, and all other staff, with a special jest for the Director of Public Works for the 12th Street Improvement project. Brown, Campbell, Forsythe, Fulton, Hastings None Motion carried OATHS OF OFFICE The City Clerk administered the Oath of Office to newly elected members of the City Council, William Doane, District Five, Paul Yost, District Three, and Shawn Boyd, District One. Councilmembers Doane, Yost and Boyd assumed their seats as members of the City Council. I COUNCIL REORGANIZATION SELECTION OF MAYOR Nominations were declared open for the position of Mayor. Councilman Yost nominated Councilmember Brown as Mayor and moved that nominations be closed. Councilmember Campbell 5-19-98 seconded the motion. AYES: NOES: Boyd, Brown, Campbell, Doane, Yost None Motion carried Mr. Brown was declared Mayor for the year 1998/1999. I SELECTION OF MAYOR PRO TEM Nominations were declared open for the position of Mayor ProTem. Councilman Boyd nominated Councilmember Campbell as Mayor ProTem and moved that nominations be closed. Mayor Brown seconded the motion. . AYES: NOES: Boyd, Brown, Campbell, Doane, Yost None Motion carried Mrs. Campbell was declared Mayor ProTem for the year 1998/1999. CITY MANAGER REPORTS The City Manager expressed appreciation for having had the opportunity to work with the out going members of the Council, and welcomed the incoming members. I ORAL COMMUNICATIONS Mayor Brown declared Oral Communications open. Ms. Audrey Kime, as President of the College Park East Neighborhood Association, speaking on behalf of the Association and other CPE residents, asked that the Public Works Department follow up on a request that the weeds along the 405 Freeway on and off ramps be removed, also reported the frequency of cable disruptions in College Park East, day and night, to which she asked that the Council address as they had said they would. Ms. Carla Watson, Save Our Pool, urged donations for this cause during the month of Mayas Seal Beach residents Bob and Eileen Griffith have pledged a match of funds up to $10,000 for that month, it is hoped that at least $60,000 of the $125,000 goal can be reached by the end of summer, and urged matching grants and corporate involvement. There being no further comments, Mayor Brown declared Oral Communications closed. I COUNCIL CONCERNS Councilmember Campbell reiterated the comment of Ms. Kime relating to the cable outages, to which she suggested that upon experiencing an outage the customer call Comcast, request credit for that day, or if the problem persists Comcast will give a week of credit however that needs to be requested, thereafter report the outage to the Assistant to the City Manager at City Hall as such records are being maintained. Councilmember Campbell also announced a promotional whereby Comcast subscribers can receive the Los Angeles Times seven days a week for one year at $1.79 per week, arrangements can be made through Comcast, this offer for new and existing subscribers. Councilman Boyd thanked all who supported his election, and predicted four good and prosperous years ahead. Councilman Yost noted that the difficulty of being a Councilperson is that decisions often do not please everyone, he conveyed appreciation to those leaving the position for all they accomplished and their service to the community, and his intent is to use their experience as a resource. Councilmember Campbell added her appreciation to Councilmembers Fulton, Forsythe, and Hastings, the best Council in her twenty-eight year residency, also welcomed Councilmembers Yost, Boyd, and 5-19-98 I 5-22-98 Doane. ADJOURNMENT It was the consensus of the Council to adjourn the meeting until Friday, May 22nd at 4:00 p.m. for a workshop to review City Council meeting procedures. I ROLL CALL Present: Mayor Brown Councilmembers Boyd, Campbell, Yost Absent: Councilmember Doane Also present: Mr. Till, City Manager Mr. Barrow, City Attorney Mrs. Yeo, City Clerk WORKSHOP - CITY COUNCIL MEETING PROCEDURES Mayor Brown stated that the purpose of this session was merely to discuss and come to some consensus with regard to the desired procedures for the conduct of Council meetings, keeping in mind the Bixby and Hellman issues that will be forthcoming. The following is an overview of comments made: * With regard to a time limitation for oral communications, the current five minutes was suggested to be retained; noted that persons have the opportunity to speak at the second oral communication; suggestion was made that the second oral communication be limited to three minutes. I * With regard to form public hearings, legal opinion was that persons should make their comments during the public hearing for incorporation into the record, however if someone chooses to speak during oral communications instead they must be allowed to do so.
